DCB Legal/UKPC - Claim form received
Hi all
I have received 11 letters and now a claim form regarding this parking infringement for over staying. I must admit I ignored them but they don't seem to be giving up so I need to do something now we are at this stage!
I am the registered keeper of the car. The car overstayed in the car park on the 22nd March 2026. Browsing was done at the retail park and the city itself with products purchased from a nearby shop to the retail park that wasn't directly on that retail park but next to it. Free parking is sign posted for 2 hours and the driver overstayed for a further 3 hours 10 minutes. I have completed the AOS as per the newbies thread and working on the defence wording but struggling a little as I have some difficulty digesting the information with the sheer amount of different parking firms and posts, my fault entirely, this is a me issue with getting bit overwhelmed.
As I understand this is the template link to start with?

Signage:
Particulars of claim
At the the time there was a marathon going on in the city at the time so the entire city was incredibly busy with traffic and road closures all over the place so parking elsewhere was made extremely difficult.
I do have most of previous letters (11!!) they sent from Oak Legal, ZZPS Limited, GCTT Certificated Enforcement Agents and the original from UKPC which I can upload and share if they are of value. The original UKPC ones have pictures of the car and the plate, there are pictures of the driver but hard to make out in the small pic but I imagine they have larger pictures that may give it away more…

Yes, use that template defence, adapting paragraphs 2 & 3
Post the Issue date from the top right of the claim form below

Thanks, 16th September is the claim date

With an issue date of 16/09/26 and providing you complete(d) the AoS before or on 05/10/26 your defence deadline date is 4.00 p.m. on 19/10/26

- The allegation(s) are vague and liability is denied for the sum claimed, or at all. The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial to the Defendant. The Defendant has little knowledge of the Claimant's case beyond the matters set out in the claim and the documentation received, save that the Defendant is the registered keeper of the vehicle. The Defendant does not admit to being the driver.
- The Claimant is required to prove the contractual terms allegedly displayed at the site on the material date, including the maximum permitted stay, the circumstances in which a charge would become payable, and the adequacy and prominence of the signs. The Defendant does not admit that the Claimant’s signage created a sufficiently clear and enforceable contract on the terms alleged.

Is anyone able to just review this before I go ahead and post it? Quite nervous without having an approval from the experts here!

You aren't 'posting' any paperwork.
You are copying & pasting the full 10 paras into the MCOL defence box. That defence looks fine.
Just follow the 8 steps in the Template Defence thread and you'll end up strutting back here in the Spring with your Notice of Discontinuance, which we need to see!

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry, I meant post it in the sense of posting it within the MCOL site but glad that is good, I will proceed with the next steps and put the defence in after re-reading the template defence thread. Thanks!

Received a call today from DCB Legal offering a settlement amount of £200, I don't think this was the mediation call as there was no mediator. I said I would not be interested in paying £200, they asked if I would make a counter offer, to which I said £10 and they said no to that and the call concluded. I imagine the mediation call will be next?
