DCL Legal - Mediation unsettled, court next step

Hi all,

Just wanted to post here, as all of the advice I see is that DCBLegal/ParkingEye is extremely easy to get out of - the "fail proof" defence "which always works" did not work, and they wouldn't settle court mediation below £150, so I rejected the offer to proceed to the next stage, based on the advice on here.

I've also read that they never pay the hearing fee for court - but due to previous information being wrong (or they're cracking down and getting more desperate) I'm not sure what to believe now.

If they do take me to court, what then? Full amount of £300+?

    Its not supposed to "work" until just before the hearing fee is due, definitely not at the interim mediation stage which tends to be an impasse stage, usually pointless in these private parking company cases in particular

    If DCB Legal are involved in a Parking Eye case, then its on the too hard or hopeless outbox at Parking Eye, hence why DCB LEGAL are involved

    The most it would be is the total amount on the claim form

    You have not told us how many pcns were claimed for, but a loss in a single pcn claim is maybe £212 , not £300+

    It will definitely go to a court, the one you selected on your N180 DQ document, they all do, because its a court claim, so decided in court, unless its settled beforehand, or discontinued beforehand, as yours will be

    Therefore, it will go to court but there won't be a hearing, due to non payment or due to an N279 discontinuation document

    We aren't wrong with this.

    It is foolproof. They will discontinue.

    The stages you've gone through are totally normal for everyone. They are the 8 steps in the Template Defence thread and nothing you have described is different or unexpected.

    You are still on the usual 8 steps.

    For some reason you've misunderstood when discontinuance happens. First you have to receive a hearing date, then DCB ring up and desperately pester you to try to get money.

    Then they give up and email a NoD over!

    Show us when you get your NoD.

    You're confusing mediation, which is a voluntary side-quest, with the actual court process.

    Your defence hasn't even been seen by a judge yet. It will cross their desk in the next few weeks or months and you will receive a letter from the local court.
