Hi,

I have just received a claim form from the county court & just wanted some advice on how to respond regarding my defence.

I originally said there was insufficient signage etc but have now been told by the driver of the car that they entered the reg number at the till in the supermarket cafe to get an extra hour free. The driver is elderly & was driving my car so may have entered this incorrectly. Will it look bad if I add this to my defence?

The added problem is being old school the driver paid with cash so I have no evidence of this!

So you weren't the driver, and haven't named the driver? Was the original pcn POFA compliant?

You should simply use the special defence for claims where the breach isn't specified.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

What do you mean by breach wasn't specified as I thought the breach was overstaying at the carpark.

Is that one of the templates on here?

I've already had a look at some of the info on here & found it a bit overwhelming so is it easy to find?

It doesn't matter what you thought

Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

Then study it and see if your assumption is stated in that POC itself, because if we read it for the first time with no background information, would we know what the actual breach was ? Just by reading the POC. ?

    I doubt it

The special template is the Chan and Akande defence template in the defence template thread in announcements near the top of the forum, read the first 2 posts in that thread, not the rest of them

And the Issue date from the top right of the claim form is. ?

No breach pleaded, so use the Chan and Akande defence template

With an issue date of 07/09/26 and providing you complete(d) the AoS before or on 26/09/26 your defence deadline date is 4.00 p.m. on 12/10/26
