2 Unfair Parking Charges, Any Advice Welcome. Xx

Hi all.

Newbie here so I hope I’m doing this correctly 🙏.

I have 2 parking charges I am disputing at the moment and I would be really grateful if anyone has any advice or suggestions. I feel so strongly that these charges are unfair that I haven’t paid either charge and now have the charges going up.

First is from Bournemouth Car Park ran by Parking Eye. I parked and started to put the reg number in and for no reason I know it had moved onto duration of stay; I’d only got the first letter in ‘G’. I wasn’t too worried as I didn’t consider this of massive importance. I paid for the whole day, displayed the ticket and got a receipt printed out for my accounts. We were there early as we were trading at a comic con there. It was about 7.10am and we’d been up very early.

I received a parking charge, appealed; assuming I would not be charged as I had a receipt and the actual ticket showing I had paid. However they didn’t accept this, but offered me the opportunity to pay £20 for my ‘mistake’ and admin costs. I didn’t accept this as I don’t think this is right - parking was already expensive, the operator was not out of pocket as I had paid, so I appealed to POPLA. They came back to me with a rejection of the appeal.

This is now at the point of ‘final Warning’. What would folks suggest I do? I feel loathed to pay this unfair charge.

Second case - sorry for the length of this post🙏. I took my 18 year old son on the first day of a course he was doing. We waited in the parking spaces allocated to the premises the course was taking place in. I waited 10 mins (we got there early to find it) then he got out and I left.
I had a charge notice from UKPS wanting £100 for this 10 minutes I waited. I appealed and again got nowhere. I then took it to the IAS with the information above. My mistake is I didn’t include evidence my son was doing a course. They rejected my appeal but stated the result would be different had I included evidence- which I have and have since sent to UKPS with no success. They also said that if this is the case I was a legitimate customer of the business park so would not have to pay the parking fee. The rejection from IAS also said that UKPS had told them no one left my car while I waited, which is untrue and totally fabricated on their part.
These have now passed it to a debt company and the charge for these 10 mins I waited is now £170.

Does anyone have any advice, suggestions or help of any sort? I do not feel either of these charges are fair and therefore do not feel I should be subjected to them.

Thank you. ❤️🙏💜

    Regardless of the backstories, you are now awaiting a Letter of Claim giving you 30 days notice and includes financial forms, followed by a Money Claim

    Meanwhile, ignore the powerless debt collectors letters or demands

  • thank you. I’m not sure whether to just pay these illegitimate fees to get shut of them or continue to fight the injustice? I really don’t know if I have a chance of beating them or if I’m wasting my time? Xx

    Read the “Newbies” thread.

    Then read a random selection of other threads to see how many times people are successful.

    The “faulty” machine where you can’t input your registration number is a well known scam

  • I'm not a forum veteran or by any means an expert, but I have read through a lot of threads on this forum.

    On the first case - if you were tempted to pay just to make it go away then the £20 offer was the time to do that. From what I've read, the worst case should you lose in court is usually being ordered to pay around £218 - not a whole lot more than the £170 they are currently demanding.

    Also, from what I've read ParkingEye rarely take defended cases all the way to a hearing these days - they will most likely go through all the motions of taking you to court to scare you into paying up, and then discontinue at the last moment.

    On the second case, same applies, but have you tried contacting the premises you were attending? 'Plan A' on the newbies thread of complaining to the business/ landowner may still be the best option. Also if the IAS did indeed tell you in writing that they would have accepted your appeal had you attached evidence, and you do actually have said evidence, then it sounds as though you probably have a strong case anyhow.

    "My mistake is I didn’t include evidence my son was doing a course. They rejected my appeal but stated the result would be different had I included evidence".

    It wasn't your mistake; the IAS lied to you.

    No evidence would have worked at the kangaroo court, where 95% of consumers see decided cases go against them. Showing that your son was on a course wouldn't have made an iota of difference: IMHO the IAS is clearly far from a real ADR and is not the slightest bit impartial, based on all the previous cases in my IAS Decisions thread.

    Please now:

    • post the IAS joke decision in my IAS Decisions thread. I need evidence;
    • update this thread only about the UKPS PCN and please post a picture of both sides of that PCN and the photos they took;

    (and to help us help you, please start a new thread about the ParkingEye case, again with pics of the PCN and the ticket with 'G' on and the final warning. NOT ON THIS THREAD).

  • Thank you so much. I couldn't deal with the 2 cases so I paid the Parking Eye scam off and now I just have the other one. Yes, I am confident that any rational person will see I didn't have to pay and that the parking company falsified info to the (not) independant appeal company. I also noticed that they took the lie that noone got out the car from UKPS without proof (as obvioulsly there's no proof as it's not true) but not my side without proof. I shall stick it out - apparently this Monday was my final warning before things escalate. XXX

  • Hi and thank you. So sorry for the delay - we've had a bit of a chaotic month.

    I have paid the first scammer off - the reg mistake - as I couldn't deal with the 2 at the same time and I thought I would have less chance with that one as they have a protocal for reg mistakes (giving you the £20 option) which I refused. If there's a chance of getting my £100 back, then I would love to go for it as obviously I was scammed. I have found out a hotel owns the land - but I had already paid them off when I found this out.

    I have not paid the second one with the falsified information. I feel with the lie they made and the fact I have evidence of our legitimate right to park there (a confirmation also from the security company that my son attended that day) means I have a much stronger case. I now have their debt company TraceGroup harrassing me with texts, emails and letters - I am now on my final warning apparently.

    I am unsure how to navigate this forum properly, so where do I - 'post the IAS joke decision in my IAS Decisions thread', please? I can add it to this thread?

    I really appreciate your help. Thank you so much. XXXX

    Oh no. You paid off the one that would have been easiest to see off! It was a doddle.
