Hello,

looking for some advice on my defence. I recently recieved correct for a parking ticket from 2024, having recieved no prior notice and not recalling ever having a fine I emailed DCB then after not recieving a response they filed a court claim. I called them and was told my only option is to defend. I''ve read the Nebies post and taken the defence template and hoping someone can let me know if I'm saying the relevant things in para 3 before I submit.

3. The Claimant's allegation that the Defendant was the driver is untrue. The Defendant was the registered keeper but was not the driver on 31 January 2024. The Defendant does not admit the identity of the driver. At the relevant time, the driver was undertaking volunteer work at Petroc College and had been given permission by the college to park on the premises. The vehicle registration number had been provided to the college and the Defendant was informed that the vehicle had the necessary permission to park and would not incur parking charges.

When attempting to correspond with the claimant initial correspondence sent was ignored, following a phone call with the Claimant no evidence of postage was given and phone call was subsequently ended by claimant with no resolve.

The Defendant denies that any liability has been established as keeper. The Defendant received no Parking Charge Notice, Notice to Keeper, or any other correspondence concerning this alleged parking charge before receiving correspondence from DCB Legal in August 2026.

Thanks

Name the private parking company claimant that have contracted with DCB LEGAL

Post the Issue date from the top right of the claim form below

Check your V5c log book has the correct details on it, because missing paperwork is no defence, due to the fact that private parking companies obtain Rk details from the DVLA database and issue the paperwork to that registered address, the typical explanation is that the RK moved and failed to update their v5c promptly

  • The car had the correct address the entire time, the parking company was Total parking Solutions and the claim date was 27 Aug 2026, Ive already done the AOS.

OK, so TPS are unusual in that they do sometimes go all the way to a hearing.

It makes no sense that no letters were received though. Are you absolutely certain about the logbook address, sorry to press you but all those letters cannot have all got lost.

And - sorry to say that isn't a defence.

You need to respond to the allegation. Why wasn't a PDT displayed, or was it a slight overstay?

I've put in there that there was an agreement with the college in that a permit was obtained, I'm unsure why no letters were recieved but I do not recall having any for this. I've given DCB a contact for the college but as theyve changed who runs the car park now they dont have any paperwork for the permit I obtained.

I've had other parking tickets from TPS and Ive paid them but this one has come out of the blue.

Do I just need to cut my loses and pay the £250 theyre asking for? And if I do what do I do about the claims form as Ive said I intend to defend?

Definitely do not pay ! ( not unless you lose in court. ), nobody here has told you to pay £250 +

Definitely defend against the claim, adapting the template defence paragraphs 2 & 3

Show us your proposal for paragraphs 2 & 3 below, paragraph 3 must refute the POC you showed us above

The previous letters went to the name and address of the Registered Keeper, obtained from the DVLA, regardless of whether they actually arrived or not

  • Is it worth going all the way to court if I have no evidence though? Wont it just get more expensive and then I end up needing to pay more as I have nothing to prove I had a permit at the time and the college arent being helpful. Is this better?

    2. Liability is denied for the sum claimed, or at all . The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial. The Defendant has little knowledge of events, save as set out below and to admit that they were the registered keeper.

    3. The defendant refutes the claims put forth by the Claimant. At the relevant time, the driver was undertaking volunteer work at Petroc College and had been given permission by the college to park on the premises. The vehicle registration number had been provided to the college and the Defendant was informed that the vehicle had the necessary permission to park and would not incur parking charges.

It wont get any higher than the total amount claimed on the claim form, but is usually around £70 less than the total claimed, and there is a thread on here recently where the judge decided to only award £100 to the claimant

So very foolish and very costly to pay the full amount !

The claimant has to prove their case, you don't have to prove anything at all. !

You haven't added the following to the end of paragraph 2

    but not the driver

"I've had other parking tickets from TPS and Ive paid them"
Ehy have you ever paid them?

"Do I just need to cut my loses and pay the £250 they're asking for?"

Obviously not! You should have already read post 2 of NEWBIES PLEASE READ THESE FAQS FIRST and seen how rare a court loss is and that the usual amount awarded is £212: A LOT LESS THAN THE CLAIM!

Stick with the easy process. It is a no-brainer to defend ALL parking claims, regardless of circumstances/defence facts.

Not sure why you didn't yet add what the instructions say to put at the end of para 2?

And you can add to your para 3:

The Claimant is put to strict proof of all data held on their client dashboard whitelist for this vehicle in the financial year 2023-2024 and they must explain why the ongoing exemption was missed or why was the vehicle removed from the college exemption list. The parking firm remain the data controller of their client dashboard, so they cannot be heard to say they don't know/ask the college.
