Lost in court

Everybody will get at least one private PCN in their lifetime. Makes you wonder if some judges actually pay them 🤣

My thought are to go after the hotel to recoup your costs over their predatory parking company, and also take the matter to the CMA
From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"6 -
It will stress you out beyond belief and you will in all probability get shafted leaving court in shell shocked disbelief.
@Smartun Definitely left in shell-shocked disbelief- good phrase!
So how did he conclude that there was such a screen visible, working and fairly drawn to patrons' attention inside the hotel?
@Coupon-mad It wasn't mentioned at all. And I never brought that up or the lack of signs on the entrance door as I felt that was the hotel's domain. I will put in a complaint to the landowner when the judgement comes through. The judge has effectively confirmed that no contract was formed. He just got the decision wrong!

You could ask Saz Solicitors (parking law experts) if they think you have grounds to appeal, because from what you said, he:
- made a finding of fact that you DIDN'T see the signs, and
- applied the wrong tests after that (Vine v Waltham Forest should have been applied) and
- failed to consider whether there was a working VRM screen inside the premises drawn fairly to drivers' attention. There was no evidence of this and the Defendant's position was that they didn't see any consumer notices at all. The screen/tablet is in itself a 'consumer notice' so where was it?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad He made a finding of fact that I didn't see the entrance sign or see signs where I parked. His position was I must have seen a sign inside the car park while driving and so should have gone back to that sign to check terms and conditions after I parked. I guess it is a question of when a contract is formed. I thought it was when I parked and left the vehicle.
Thank you- I'll look into Saz Solicitors
