Horizon - Late delivery of NtK - Appeal success?

Hi folks,

I am currently appealing a parking charge from Horizon from July.

Brief facts:

Alleged breach: 25th July 2026

Parking Charge Issue Date: 4th August 2026

Reason: Exceeded maximum stay period ANPR

My initial appeal to Horizon (rejected this morning) is that:

a) The ANPR doesn't establish 'parking' period (although this is weak, as the alleged overstay was c.30 minutes and it's a small car park).

b) They failed to meet Para 9(4) of PoFA. The 14 day clock means I should have received the NtK no later than 8th August. I have submitted that I went on holiday on the morning of the 10th and hadn't received the notice by then, so the post on the 10th was the earliest day it could have arrived. Obviously it's impossible for me to evidentially prove this. The policy and guidance allows them to assume receipt 2 days after postage, but there's nothing on the letter or envelope which proves when it was posted. Date of Issue does not establish date of postage and there's no dated postmark. So feels like my word against theirs.

Horizon have rejected this, but have not addressed argument (b) at all in their rejection email.

Question is, do I try with POPLA or just take it on the chin and pay the reduced fee? Does anyone have any experience or success stories with this line of appeal argument?

Thanks!

    No paying

The issue date was 4th August, presumed to be delivered 2 working ( business ) days later, Thursday 6th August, so within the 14 days if they are invoking Pofa2012. Late delivery is not their problem unless you can PROVE the date that it was delivered, so the onus switches over to you to prove lateness

Frankly , I don't believe that you would win at popla

Easier to fight a court case, especially for an overstay , so that is my advice

You shouldn't bother with POPLA but - given everyone has to read the NEWBIES FAQS thread before posting - what happened when you tried Plan A first?

Horizon ones are usually a cinch to get Tesco or other retailers to cancel.

  • Plan A wasn't applicable. The car was parked in the 'main' car park in the small town (in a small shopping precinct), but the driver was using the library which is in another (nearby-ish) part of the town, but not part of the same landlord's property. So there were no receipts/etc to show to evidence for a local retailer.

How so? Tesco seem to be the most uncooperative of all the supermarkets.

Depends on the branch. Head office won't but some branch managers will.
