hi all

Hope you can advise what to do next. I appealed an excel charge using your template on the basis that the driver made qualifying purchases within store entitled to free parking. I was expecting a straight out rejection based on what I read about this car park before but instead they’ve replied asking me (as keeper) to identify the driver in order to progress with the appeal.

They’ve then tried to bribe me into paying by putting the ‘discount’ £60 back on the table for 14 days.

Not sure how I should approach this next. Appreciate your advice.

Ignore them, they are phishing for the drivers details, a common tactic by private parking companies when a keeper appeal is used

Plan A is always the preferred tactic in these cases ( plans B & C were never going to work )

the retail store said they can’t help. I found out the landowner is Birmingham city council. I’ve tried to ask my councillor to help but I’ve not heard back from him. Does anyone know how I can appeal to the council directly?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You can simply tell them the Single Code of Practice they signed up to allows the recipient of the Parking Charge Notice to appeal to the operator and subsequently to the IAS / Popla. None of their questions are applicable.

Therefore continue to process the appeal.

Remind them that this correspondence will be included in any court Witness Statement.

(obviously you realise that both Excel and the IAS will reject your appeal, no matter the reason).

excel responded me to reject my appeal (shock) but offering a £20 bribe to pay now. I am tempted even though I know it’s giving in to the worst people but I don’t know if I have the mental energy to see it through

the £20 is less than the original £60 bribe they offer. Does it suggest that they think they would lose if I took it further and so they are just trying to get whatever they can?

I am really scared of losing a claim. I can’t afford it. What I’m asking is do you think they believe they’ll lose which is why they’re offering £20?
