The Saga of The Cancelled Emirates Flights
Our holiday flights to Thailand in April with Emirates were cancelled owing to the war. We received a prompt refund for the original tickets and further requested a refund to some upgrades we had purchased. £640 in total, paid for in two £320 transactions financed via PayPal pay in 3 facility. Eventually we received one £320 refund. Since then despite numerous conversations with Emirates directly and PayPal the second was not forthcoming. As I was getting nowhere I asked my bank to do a payment recall, and after a 45 day wait they refunded the money. PayPal had not responded to them.
I then find that my pay in 3 account now shows a missed payment of £320. I have received emails and calls asking me to pay, which I have refused. PayPal said I needed to speak to Emirates. I did and my travel agent also did numerous times. We now have reached an impasse. PayPal has sent my account to a collection company. Emirates says the refund has been made in total and will not discuss it any further.
I am stuck between 2 large organisations and have no idea how to resolve it....HELP

I can see PayPal's point, you have borrowed £640 from them and have defaulted on repaying half of it.

Who was the upgrade refund from? If it was Emirates then I would say they still owe you the rest. If it was PayPal then that's who you need to chase. But I'm guessing.
@sourcrates - have you ever dealt with a situation like this? It's outside the usual debt stuff we deal with and I wasn't sure what to suggest.

Based on your account, your problem is that you've chased the wrong people.
Your issue is with Emirates, and you need to get the refund from them.
You have gone to your bank, who have (presumably) refunded you the £320 that you paid to PayPal. PayPal are not at fault here, and are not liable under Section 75 as the payment was prior to July, so understandably in their eyes you've defaulted on the payment.
- Explain this to your bank and get them to reverse the credit
- Try paypal protection by filing a dispute. They have myriad terms, but I believe for an item that wasn't received you have up to 180 days to make the claim
- If unsuccessful, keep chasing Emirates and ultimately issue a small claim.
