Smart Parking/DCB Legal Claim

I got some really good advice on here and have been following the newbies thread and instructions after receiving a claim from Smart Parking and DCB Legal.

I have received the hearing notice and directions. I filed my WS and pictures of the lack of signage as supporting evidence on the deadline of 7th Septmeber as per the directions and copied DCB Legal.

The court seem to be getting wise to the operation of these firms. They gave really clear directions to the Claimant on what the Judge wanted to see.

They have also said that if the hearing fee is not paid by the deadline then it will be struck out and the claimant will be liable for costs unless the court directs otherwise. I wasn't considering applying for costs even if struck out as I thought the default position would be no costs and I didn't want any additional stress but I might consider it now as it has been very time consuming.

I haven't received a witness statement or any of the requested documents from DCB Legal so they have missed the deadline. I haven't heard anything from them apart from the usual automated calls. The hearing fee is due tomorrow 10 September by 2pm so I am eagerly awaiting their next step.

Great to read that you've used this forum's resources without needing a thread, and know that soon you'll get a discontinuance.

I suggest you email DCB Legal now, saying they've breached the hearing order and if they don't email you the NoD by return this week, you'll attend the hearing shortly and will claim attendance costs plus further costs in the indemnity basis.

So deadline has passed and still haven't heard anything. Spoke to the CNBC who checked the shared file and DCB haven't filed WS or documents.

They said it looked like hearing fee wasn't paid either but could be a delay with updating so have emailed the allocated court to request info and confirm strike out.

Will also email DCB Legal. Definately going to apply for costs as they are just wasting everyones time.
