Smart Parking Ticket have issued late notice

Evening everyone.

I did read some of the topics here related to this company (being unreasonable one etc). I still struggle to understand whether I should contact them with appeal or simply ignore them…

I’ve received the letter today, even tho the incident happened on 14/08, letter issued 02/09.

The situation:

I’ve had an incident at Stratford-upon-Avon with the car being parked at a private parking (The Embankment), issue is that I’ve paid for “Recreation Car Park” that is literally few meters away from this private parking, I genuinely did not see that it was private as ticket machine was near the entrance and I assumed that’s where I need to pay for so I did pay for it thru my phone “Ring Go”. Later that evening (after 1.5 hour when I came to car I noticed another ticket machine and questioned whether I paid for a right spot, upon realizing it I’ve moved my car to where it’s supposed to be.

It seems unfair for charging me £100 (discount £60) for such mistake where it wasn’t that clear where I should pay for it, still paid, but unfortunately wrong spot…

I will attach to this topic letter and hope someone can advise me what to do really.

This is Non-POFA so the keeper is not liable. A keeper appeal can be made but Smart will now reject this and claim they can pursue the keeper on the assumption that they were the driver.

With or without a keeper appeal, you ignore Smart unless they send a Letter of Claim via their pet lackey DCB Legal. Every defended claim for Smart gets discontinued. Nothing to pay and no danger of a CCJ.

Do tell them if you move in the next 6 years.

Yep just ignore it and come back when you get a claim form or LBC from DCB Legal. You need to read NEWBIES PLEASE READ THESE FAQS FIRST.

You will never have to pay this.

I don't know if this is helpful to the OP but Smart Parking have over-stated the charge to call an 0330 number. It's the same as an 01 or 02 number and there is no "access charge".
