MET Pcn at KFC Gatwick airport

Hi,

Could someone please advise regarding the attached PCN from MET Parking?

The stay was supposed to be authorized by giving the parking ticket to the staff, who would then scan it. This was done, but it appears the staff member made a mistake and the exit barrier did not lift.

The buzzer on the exit barrier was then used and the barrier was raised by the staff member without any conversation taking place.

Afterwards, went back and spoke to the staff, explained what had happened and showed them the bank transaction confirming payment. They advised to appeal the PCN and send the bank statement/payment evidence, and said that it would be cancelled.

Would someone be able to advise whether this is likely to be sufficient, and how best to word the appeal?

Also, as this occurred at KFC Gatwick airport, would it be appropriate to appeal on the basis that the land is not "relevant land" for the purposes of Schedule 4 of the Protection of Freedoms Act 2012 (PoFA)?

I appeal this Parking Charge Notice as the registered keeper. I do not identify the driver.

The alleged location is KFC Gatwick, Ring Road North, RH6 0NN, within Gatwick Airport. Gatwick Airport is subject to statutory airport byelaws. Under Schedule 4 paragraph 3(1)(c) of the Protection of Freedoms Act 2012 (POFA), land subject to statutory control is not “relevant land”. Therefore, POFA keeper liability cannot apply and MET cannot transfer liability for the alleged driver's charge to the keeper.

Furthermore, the Notice to Keeper is not POFA compliant. In particular:

It does not contain the mandatory keeper-liability warning required by Schedule 4 paragraph 9(2)(f).

It does not specify a defined “period of parking” as required by paragraph 9(2)(a), merely giving an observation time of 23:14.

It gives a “date of issue” but does not specify the date the notice was actually sent, as required by paragraph 9(2)(i).

A genuine purchase was also made at KFC on the relevant date. I attach a redacted bank statement as evidence of this. This is provided without identifying the driver.

As the land is not relevant land and the Notice to Keeper does not satisfy the requirements of Schedule 4 POFA, keeper liability cannot arise. Please cancel the charge. If you reject this appeal, please provide a detailed response addressing each point raised and issue a valid POPLA verification code so that I may refer the matter to independent adjudication.

Hi, we appealed as online appeal was still available and appeal submitted as well even though it was over 28 days, we have received the below reply, they have rejected appeal saying it was outside 28 days period and even if we had made appeal within 28 days they would have rejected anyway, they say kfc is private land and does not come under airport byelaws. what should be the next step? thank you

As advised on the charge our appeal process is open for 28 days from issue of the charge and the time period for lodging an appeal is now closed and the charge remains outstanding and payable. Whilst we have not considered your appeal it is likely that had you appealed within the 28-day timescale the appeal would have been unsuccessful as the driver of the vehicle failed to use a validated ticket to raise the exit barrier in breach of the notified terms and conditions and confirmed they had not validated their stay by pressing the button to raise the barrier. Please note that this is private land and does not fall under airport byelaws. This charge was not issued for an overstay. It was issued as you had failed to validate your stay. Copies of our previous correspondence have been enclosed. Please note the charge is due to be passed to our debt resolution agents for collection on 17/09/2026 which will incur you further costs, to avoid these costs please ensure that payment is received before that date. Payment may be made online at www.paymetparking.com or by phone on 020 3781 7471.

By law we are also required to inform you that Trust Alliance Group (https://www.trustalliancegroup.org/) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. Further correspondence sent to us regarding this parking charge may go unanswered."

But show that fob off to KFC Head Office and ask them to cancel it under these unfair circumstances.
