PCP - Legal rights
We have a 2024 Nissan Xtrail Epower 4force, purchased new in October 2024.
It developed a low speed noise from the rear. We reported it to the dealer at around 7 months old.
In the last year it has had the brakes replaced all round, then and none of that worked. The dealer has had it for the last 6 weeks and have replaced the gearbox and traction motor. They believed they had found the issue because when they took the oil out it the oil was dark and smelt burnt. This didn't resolve the issue and it's still got the same issue when the dealer took it out again.
We complained to Nissan but the MDs office have been shocking, telling us multiple incorrect statements, in writing.
My wife is having to spend many hours a week dealing with this, she's self employed so not only is it costing us actually money paying for a car we don't have but we are actively loosing money.
Do we have options for a legal case? Nissan finance are dragging their heals on responsibility, they are waiting for the car to be fixed. Which each week is taking longer and longer.
