If you compromise your PIN, Password or account details in anyway under T&Cs you have to inform your Bank/Card Issuer.

If your details are compromised by a third party, (as in this case), or by the card issuer, where do you stand? Shouldn't you be informed?

Do Banks and Other Businesses Have a Duty to Notify Customers of Computer Security Breaches?

    http://writ.news.findlaw.com/ramasastry/20050713.html

    Questions:

    1. If known, what was the date of the breach? - its has been reported as long as 10 months ago.
    2. If you've been the victim of fraud (anywhere) and used your card to buy goods or services in or from the States from the above date were you warned that your card details had been compromised?
    3. Did you have to pay the first £50 of any fraudulent/disputed transaction?
    4. How much did you spend on phone calls, form filling and putting things right?

Knowing what you now know do you think you should have 3 refunded and be compensated for out of pocket expenses and time spent putting things right at 4?

Or if you've used your card to purchase good services from the USA wouldn't you like to be at least warned that your account is now more susceptible to fraud world-wide through no fault of your own?

Nationwide, according to the call centre lady today are in the process of replacing ALL cards of accounts they THINK have been compromised in the USA.

Having used both debit & credit cards to buy goods in or from the States I am erring on the side of caution and having both replaced.

So far that’s Nationwide and First Direct that are taking action.

Has any other reader been contacted by their card issuer yet and if so which one?

February 2003 - 8m Caught in US credit card fraud.

    http://www.guardian.co.uk/online/security/story/0,14230,1145126,00.html

Was this the beginning of the 40m accounts compromised?

Why were UK cardholders who've used their cards before this date in the States or to buy goods from the States not informed?

If you have you used your card in the States before Feb 2003 and suffered from fraud since and incurred any expenses I'd be asking questions.

First Direct & Nationwide replacing compromised cards on recent breach. How many UK card issuers re-issued cards on the above breach?

I think no-one else cares, because they realise their credit cards protect them fine if fraud does occur on their credit card.
