Small claims court- company has not paid up

Dear all

My son spent £200 on a pair of Cleens trainers on-line from the company website.

After about a year of use, the sole of one of the trainers started to come apart.

After complaining to them about it, they offered a poor discount on a future purchase.

He went through the small claims court and they did not even respond, so the Judge ruled in our favour.

However, they still have not paid up, so what would be the next steps?

Thanks a lot

It looks like they are a UK Company with assets.

As always next steps will involve enforcement costs.

When was the CCJ issued? Is there a possibility the company could claim they didn't receive the court papers and ask for a set aside?

If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

As you've found, winning in court doesn't in itself mean you'll actually see the money - step 6 here explains next steps:

Cleens.co.uk website has several of the hallmarks of a ropey website, they arent declaring their legal entity, they say they are governed by UK legal jurisdiction which doesnt exist. The only thing that gives confidence that they are really uk based is the next day delivery for orders before 8pm

Their registered address is that of their accountants and so there are going to be no company assets at that address to send bailiffs around for. They list no addresses on their website at all so whilst you have a court order enforcement is going to be more problematic.

Presumably you attempted a return before court action so did their returns portal given you an address? Have you checked what that address is? Could just be a fulfilment company so again you may have a deadend for enforcement action. Unfortunately the win rate on small claims is massive but the overwelming majority are just won on default. The courts systems dont officially publish an official rate of what percentage of won cases are ever paid out on but evidence from others suggests its a relatively low percentage which is why the recommendation is always to look at the recovery prospects before sinking more money into the loss via court fees etc

  • Thanks for all the replies

He used the official account to order the trainers.

CCJ issued in March but no company response at all.

The returns address just seems a warehouse unit.

Thanks for the replies- best advice from me is for all the steer clear of Cleens- poor products and a rip off company!
