DCB Legal Court Letter

Hi Everyone,

I really hope someone can help as I’m very worried and anxious.

I’ve had a court letter regarding a parking fine from DCB legal dating back to October 2022. I did park for a very short time as my daughter who is type 1 diabetic was having a hypo. I was not aware that parking was not permitted and did not see any signs. I have already tried to plead my case when I heard from DCB legal back in June this year. They would not accept my appeal. I now have a load of forms including a claim form, defence and counter claim and admission. I now owe £253.63.

Any advice on where to go from here would be very appreciated. I’m not keen on paying because I can’t afford to but also it’s the principle of it. However, I’m so anxious that this is going to end up with me in court and a huge fine.

Can anyone help please? I’d really appreciate any advice.

Thank you.

Don’t panic and don’t ignore the claim. Get some advice from a reputable parking/consumer forum and make sure you meet the court deadlines. Keep any evidence about your daughter’s medical emergency and what happened that day.

Thank you. I can’t tell you how much I appreciate the replies. I’m so anxious but don’t want to give in and pay.

You'll never have to pay because DCB Legal discontinue all Smart Parking defended cases. This is easy stuff!

    I've redacted the password:

There is a current tsunami of Smart Parking claims. So much so, that I now have copy & paste advice ready:

Just click on the username @Meltof

Copy their version of a Smart Parking final defence posted on April 12th. Obviously, as they didn't use the POFA until 2025, theres no 'keeper liability' possible with Smart's claims for old PCNs.

These claims are all the same (none go to hearings) and the sheer numbers of Smart Parking claim threads - about half a dozen new ones EVERY DAY here - have driven us regulars a bit mad recently, with this batch!

    Literally read any Smart thread…

Follow the 8 steps in the Template Defence thread which also covers Mediation.

It'll be discontinued just before the hearing fee falls due in the New Year, as they (Smart/DCB Legal) never pay it.

Read @Umkomaas' thread of over 900 examples & counting! Yours will be on that list.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you only heard about this PCN once DCB traced you, that will be likely because you didn't update your new address on your V5C, back in 2022. That's how people miss PCNs.

Is it correct on your car logbook now? You can't move and only update your driving licence. The logbook has to be changed too.

Make sure you do that in future but you'll never have to pay this invoice anyway!
