I’m being chased for £170 over a disabled parking bay

I was transporting people I support who have significant disabilities, including autism and learning disabilities.

I parked in a disabled bay with a genuine, valid Blue Badge. To the best of my knowledge, I displayed it properly, but it seems it may have slipped or fallen out of view afterwards.

The parking company says the badge wasn’t visible when the car was checked, but my understanding is they don’t have video showing whether I did or didn’t display it when I originally parked.

At the time, my priority was getting vulnerable people safely out of the vehicle in a busy car park, not repeatedly checking whether a Blue Badge had moved.

I provided evidence that the badge was valid, but the charge has now escalated and BW Legal are demanding £170.

I’m not saying parking rules shouldn’t exist. I’m asking whether this is actually proportionate when the disabled bay was being used for its intended purpose and the only issue appears to be that the badge wasn’t visible later.

Has anyone else dealt with something like this, especially with a private parking company or BW Legal?

Errr - yes - we deal with these cases every day! You will NEVER have to pay this invoice because no judge would uphold it - and there is no CCJ or costs risk.

Nobody pays these unfair invoices, and the added £70 is unlawful (double recovery of the standard letter-chain minor costs that the Supreme Court held that a recoverable PCN 'must' already cover).

Of course it's not proportionate; in fact the whole charge in your case is illegal - an Equality Act breach - if they know you were a carer of disabled passengers that day.

Sounds like you did appeal and explain - and attached the blue badge, yet they didn't comply with their legal duty to make a 'reasonable adjustment'?

Did they offer to 'settle' at £20 (still illegal under the EA), but the non-impartial joke of the farcical 'Joint Code' includes that to keep the money flowing for this rogue industry, despite the fact they can't legally impose a charge (for admin or any reason) against a person with (or caring for passengers with) protected characteristics for using a disability provision in place for them.

It would be like charging £20 for a disabled person 'moving too slowly and taking too long' in a shop. Oh wait, this rogue sector issues unfair PCNs for that, too!

Show us the PCN and their photo evidence, and your appeal and their rejection letter.

Redact your data, PCN ref, and your VRM.

BWLegal has added a FAKE £70 which a feeble attempt of DOUBLE RECOVERY … The courts do not like fakers

Thanks so much for the response @Coupon-mad and apologies for the slow reply!

I did think the whole thing seemed a bit unreasonable and unfair if I'm honest. I've come across these PCNs before and I've paid some and not others - on this occasion I don't believe there's any grounds in which I should pay.

I've attached some screenshots of all the information I have. I can't seem to find the copy of the original PCN. Could I email Premier Park and request copies of all correspondence?

OK. Ignore Premier Park and only respond to BW Legal when they issue a LoC or LBC, as explained (and you should have read about before posting) in post 2 of NEWBIES PLEASE READ THESE FAQS FIRST.
