PCN Compliance Parkingeye for Aldi

I challenged a Parkingeye PCN because it did not specifically say which term of the contract was supposedly broken. All it said was that the vehicle had been parked for 1hr34min. Parkingeye rejected the appeal and I have applied to POPLA.

In the interim, despite behaving like Pavlov’s dog with all supermarkets, I received another PCN relating to the same Aldi. This one said the vehicle had been parked for 1hr12mins but again did not specifically say which term of the contract was supposedly broken. I have challenged Parkingeye again on the same grounds.

Aldi has a 1hr30mins parking limit for shoppers (I shopped). Among the many contract terms I could have broken could be overstaying or not using the checkout terminal, or both. As one PCN is 1:34hrs and the other 1:12 it is not clear what the charge relates to.

I have argued in both cases that I cannot contest either of these unless I know what term or terms have been broken. As far as I am concerned, the second PCN being within the 1.5hr limit proves my point.

Do I have a reasonable argument to dismiss these PCNs? If so, if every Parkingeye PCN does not specify the specific breach are they all worthless?

Well I suspect that if you never used the terminal that is the reason.

What did your POPLA appeal say and what reason did they give for rejecting, not that it matters as you don't have to pay it because they say so.

Plan A in the NEWBIE sticky is to complain to the Supermarket. What happened when you tried that?

I now have POPLA’s response rejecting my appeal that the PCN did not specify what condition was broken. The key part of POPLA’s reason for rejection is:

‘Please note, that there is no legal requirement to list the terms and conditions of the parking contract on the PCN, only the requirement to state the breach. … the reason for issue was listed on page 2 ‘Parking charge information’. It states the reason for issue is by failing to gain the appropriate permit/authorisation.

However, the full sentence on the PCN is: ‘By not gaining the appropriate permit/authorisation OR (my caps) by remaining at the car park for longer than permitted…’

On one hand POPLA is saying a PCN requirement must be specific about the breach (singular) yet ignores the option of two breaches Parkingeye have listed on the PCN.

How can a response be made if you don’t know which apparent breach it is? This should be challenged.

STOP taking cases to POPLA. Stop!

Do not pay the first one (ignore it until court claim) and do not try POPLA with the second one.

You've just thrown away your Aldi cancellation of that first one. Do it right for the second one.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Just contact ALDI HO direct & ask them politely to get the charge cancelled. Find the CEO’s email at ceoemail-dot-com.
As others say: don’t waste your time with POPLA or scratching your head trying to find loopholes. Assuming that all you did was spend money in Aldi - doesn’t matter how long you were there; the nice people working in CEO Giles Hurley’s Executive Office at Aldi will sort it for you.

Aldi cancelled my latest one yesterday: 3.5hrs this time, according re Parking Eye. Hard to believe, but - so what? 🤷‍♀️ All we did was shop in Aldi & we didn’t inconvenience any other shoppers. So how long we spend there is our business. The 90 min limit is irrelevant.

This time I did rather ‘make my feelings known’ about Parking Eye to the nice man at Aldi. He replied “hopefully you will notice some changes regarding the car parks soon”. ⁉️We can only hope…
