I have just received an email from Times parking charge stating that my previous appeals (used the POPLA template on other threads) has not worked and my charge still stands. Any help gratefully received.

my Times letter appears to be different from others stating that

“as this charge is not being persued under schedule 4 of the Freedom Act 2012, we are not relying on statutory keeper liability provisions on schedule 4, so it’s specific conditions do not need to be met. In the absense of driver details, we rely on the principles considered in Elliot vs Loake (1982) when assessing, on balance of probabilities, who was driving.”

I cannot see this reply of any other current thread. Does this mean I now have to pay?

Elliott v Loake (1982) is a criminal case where the court concluded the registered keeper of a car was also the driver because physical and forensic evidence proved it, not because a keeper is automatically presumed to be the driver.

This does not apply to their claim they are trying to con you, the land is under airport byelaws the PoFA does not apply, they have no idea who was driving and they cannot hold the keeper liable.

Just ignore them.

I’d taken the advise to ignore the charge. However I’ve since received a Trace debt recovery letter. I’m a bit worried now..

Trace are debt collectors who you ignore. You need to block out your registration VRM on letter
