Exactly. Precisely why I have been interrogating the responses. Not because I want people to agree with me but because I want to understand who knows what they are talking about.

So where there is a careless misrepresentation, insurers can put consumers in a position where they either (a) stump up for the additional premium (which seems to be an entirely arbitrary figure given when I disclosed all the information correctly on a comparison site 1st Central quoted more or less the same as the original quote) or (b) face an insurer cancellation and all the ramifications that entails?
Surely people can see how that seems to be an entirely unreasonable position for consumers to be put in?

You consider it a careless omission but 1st may hold a different opinion. Hence the increased on premium.
Your application on the comparison site does not include details of that omission.

I'm afraid this comment suggests another person who has no knowledge of insurance or the relevant law and regulations proffering their opinion.
Under the legislation misrepresentation is either careless or reckless / deliberate. The remedies available and approach of the insurers are different depending on which it is. The fact 1st Central offered to continue covering me at an increased premium is confirmation they consider it to be careless. If they thought it was reckless / deliberate they would have voided the policy and kept the premium.
After the initial call on 11 August, I ran another comparison with all the information included. 1st Central offered cover at more or less the original premium.

Did that information include the fact that you had omitted the fact that you had had two claims on a previous insurance?

I don't think that last bit can be counted on as evidence for your argument. Comparison websites only return what you might call an estimate, which then takes you to the actual insurer where you have to make proper declarations and "sign" for them. Did you proceed all the way to the point of payment? If not, you may have found that you got a different figure, or that they'd want to speak to you before offering a policy, knowing your history with them.

I can, but as I posted just now, the arbitrary figure you suggest in (a) may not be arbitrary, given that there's doubt to the foundation of your argument that they were prepared to cover you for a similar amount as the flawed policy cost.

1st advised you of the new premium, which covered the correction of the error, do you not think that it is fair that you pay that rate for the period that you were covered by 1st? Rather than the incorrect rate?
