CP Plus Refusing to process appeal
Apologies if this is long or has been covered elsewhere.
My partner as RK received an Overstay PCN at the end of June whilst shopping I our local Matalan.
The NTK was issued on the 14th day after the Overstay, and received around the 17th day.
Firstly, we spoke with the store manager. Who emailed the Landowner and had the charge cancelled.
She then received another letter regarding the PCN around a week later. To which we appealed as the keeper stating under POFA 9(4) there was no keeper liability. I believe this is correct as the original NTK was received late. They replied to this, stating the charge was on hold and requesting the drivers details.
We replied with the below:
They have no responded again with the following:
Before I respond again, has anyone got any further advice? As they don't wish to confirm cancellation of PCN or issue a POPLA Code.
Is there a time limit for appeals that they have to accept or reject the appeal within? Or are they allowed to keep putting the PCN on hold. First appeal was August 4th, responses from them were 13/8 and today 20/8

Go back and say this
I am appealing as the registered keeper. It is a well known fact group nexus like to do fishing expeditions for driver details.
I am copying in Sara at the BPA as your statement is completely misleading. Parking companies are known to lie to motorists and this will not be tolerated.
Sara. Please see the enclosed . Clearly this parking firm is lying. Are you proud of this behavior?(see email trail)
I will NOT tolerate being lied to.

Ignore that response and wait for a popla code or a cancellation after their self imposed deadline ( they are phishing for the drivers details. )

Or send my reply above....

Yep, a good robust reply like yours could get it cancelled ( should it say NOT TOLERATE ? )

COMPANIES HOUSE
If you look up CP PLUS, you will see a LORD AUSTIN OF DUDLEY as an active director ? He is indeed listed on many companies. Is he a real Lord and if so, what is he doing in the great parking scam
Do the same with Group Nexus and you will see 4 First Officers. All hiding behind a correspondence address
Correspondence address Jack Straws Castle, North End Way, London, England, NW3 7ES
Do a google search forr this
What is the REAL address for CP PLUS AND GROUP NEXUS, thE BPA SHOULD KNOW if they are giving them access to the DVLA database
And by the way …. Lord Austin is a member of the labour party
A lord operating within the PARKING SCAM ….. whatever next
CMA, BURNHAM, RAYNOR sort this rubbish out

Lord Austin resigned from the Labour Party in February 2019 and was made a life peer by Boris Johnson in 2020.

Looking at GSV, the building has a GroupNexus sign on it.
Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'

CP Plus = Group Nexus (sort of)
@parkenator what response did you get?
When Steve Clark had Sara's role he used to come down on firms like a ton of bricks when they lied or implied that a registered keeper recipient of a notice has no right to appeal.
But since the BPA and IPC effectively formed a cartel with a bent 'Joint Code' with 30 disingenuous clause changes in it (including the one allowing members to block registered keepers from appealing but sue them anyway) they are almost at IPC gutter level now, IMHO.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
