Parking charge notice >>> electric vehicle >>> Geniepoint >>> Premier Inn

I have been served a £100 parking charge notice for charging my car at a PUBLIC CHARGER in a Premier Inn car park.

The
car park has two sections that do not appear to be joined. There is no
signage where I entered. There is no barrier at entry. The charger
itself has a vague sign, "Parking restrictions may apply, please see
separate parking notice for details." A nearby notice states, "Public
paid parking. Please pay on arrival". The car owner would need to
download an app. No terms or tariffs are displayed.

The blue
signs also state, "Non-electric cars in the marked space will receive a
penalty charge notice." This rather suggests that those with electric
vehicles will not.

It appears therefore that in these
circumstances, the car owner needs to enter into two separate contracts:
one for the charging and one for the parking.

I feel that the
signage is inadequate to suggest that a parking contract is required. I
appealed, but I was warned that my appeal would be automatically
rejected.

Any ideas, please?

This is confusing, why did you receive a charge, was this a PCN from Horizon, you cannot get a "penalty charge" on private land, that sign is an information sign presumably placed by Geniepoint which is giving incorrect information and they should be called out for it.

There must be further signage on site that attempts to make a contract from Horizon, have you complained to Premier Inn?

Neither of those signs offers you a contract that they now accuse you of subsequently breaking.

If there's nothing else near the charging point I don't see how you have entered into a contract with Horizon.

Plus, the general consensus is that charging isn't parking.

They'll be other signs with the contract on, so Popla won't be any use to you. So you'll have to try kicking off to Premier Inn.

Eventually they may make a court claim, but looks very defendable.

Show us the letter from Horizon, minus personal details as they're sometimes non-compliant.

Thank you. The Beefeater public house next to the Premier Inn urged me to appeal and provide a copy of the charging details and receipt.

Then its not a Penalty Charge, its a Parking Charge Notice , so please edit your thread title accordingly

Post a redacted picture of both sides of the pcn, no personal or private information but leaving dates and times showing

Post A verbatim copy of the appeal that you appear to have made to Horizon Parking

Ideally complain to Premier inn, or Whitbread themselves, plan A

Thank you so much. The Beefeater is due to close very shortly, perhaps within days. Do you suggest that I complain to Travel Lodge at the local hotel or nationally at its head office?

Thank you. Based on my somewhat rusty legal analysis, I would think the signage does not constitute a clear offer. I am pleased that you concur. I had imagined that Genie would pay Premier Inn for placing a public charger on their land. It appears this is not a public charger at all, but rather a facility offered to people who have entered into a parking contract.

I would complain about it to both myself, because although the restaurants are closing, the hotels aren't , so i dont know what the Beefeater restaurant has to do with this

Don't be fooled by the Blue sign, that incorrectly states Penalty instead of using the correct word Parking

Yes there are more than one contract, one is for refuelling the vehicle in a marked electric bay, the other is a Horizon Parking contract with the driver when using the car park ( private land )

Premier Inn partners with the GeniePoint Network to provide high-powered electric vehicle chargers at select hotel locations across the UK

If you received a Parking Charge Notice (PCN) from Horizon Parking while staying or visiting a Premier Inn, it is usually caused by failing to register your vehicle registration plate at the hotel reception terminal or an error with paid parking apps. As a legitimate guest or patron, these notices can almost always be cancelled.

No penalty was issued, because its an impossibility, so has to be a Horizon Parking Charge Notice

Its not a public charger, its a private charging facility by a private company ( GeniePoint ) on private property owned by a third party, ( probably Whitbread ) for use by the public but overseen by a private 3rd party contractor called Horizon Parking ( where incorrectly worded signs are in use. )

Is the NTK a POFA-worded one on the back? Horizon use different versions.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
