Parking fine from Civil Enforcement Limited

Got a parking fine a while ago, but due to moving house, didn't receive the letter in the time I was given to appeal. It's now reached a stage of receiving a "Letter Before Action", but I'm still unable to dispute.

I was accused of staying in a KFC car park for 3 hours and 30 minutes, which beyond being a ridiculous thought to begin with, just wasn't possible. I have bank statements showing that my partner and I both made a payment there. Beyond that, the evidence that they had provided only showed me entering the car park - no exit. I saved the evidence when I first saw it, and it now seems like they deleted it on their website (scummy).

I'm going to file a complaint on their website providing the pictures, and was wondering if I should post bank statements, or anything else? Also completely unsure how to word the complaint. Any help appreciated, thanks!

It's not a fine, just a speculative invoice. If you want to, use the standard reply to letter before/of claim/action that you will find in the NEWBIE sticky second post and then wait for the N1SDT claim form. The court hearing is where you will win - unless CEL discontinue just before the hearing fee is due.

Make sure that your address is up-to-date on your V5C and inform the DPO of CEL of your current address for service and require them to ERASE any older data.

I'm going to say that looks like falsified falsely used to invent an overstay) images.

As you say, that is clearly two entry pics and now they've DELETED them?! Wow.

You are always entitled to dispute an incorrect/unfair parking charge at pre-action stage, under the PAP for Debt Claims.

Please show us the LBC. Is it from CEL, or DCB Legal?

I can't decide who you need to report these false images to first! The CMA or ICO. We can discuss that.

But first, after showing us the LBC, send a data abuse complaint to the DPO at CEL:

    • telling them to erase the old address (copy the LBC response in the second post of the NEWBIES thread) and
    • asking for their ANPR evidence (all captures of the car at that site that day).

Do not tell them that you kept these images. Let's see how the DPO replies…

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
