URGENT: Help with CCJ (Context Explained Below)

Hi There,

I'm in a bit of an awkward predicament and some advice would be appreciated.

I had a CCJ against my name on the 8th July as the court claimed twice that they had not received the claim form within the time stated (This was not true as they emailed acknowledgment)

As per the judgement I had 30 days to pay for the CCJ to be set aside.

I then called the court and I suggested that I will send proof that I did follow correct procedure by special next day delivery.

The court only sent me a letter on the 4th acknowledging that they had received my letter and that a judge will look into it.

Given the set aside deadline and the fact that the CCJ was much lower than a N244 form - I decided to not "chance it" and pay the CCJ (reluctantly and only to prevent it being on my record)

I made the payment on Friday 7th (the day before the final day that I had to pay within the 30 days)

The next day (the 8th) - I received another letter from the court confirming that a district judge looked into my case and that I did send the claim form on time so the case is being set aside for allocation.

I now of course want to fight the case but I did also make the payment.

Any suggestions, advice on how to proceed and how best to go about this would be great.

Thanks!

OMG that was a terrible decision. They will now discontinue or tell the court it is settled, leaving you up the creek without a paddle.

How did you pay? Credit card?

Put the payment in dispute with your card provider immediately and reverse it as a scam online payment made under duress.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

How much lower was the judgment compared to the N244 fee?

I agree a chargeback would be your best course of action, failing that a demand for a refund from whoever received the payment on the basis that the claim is set aside and no monies are due.
