Company Lease Vehicle PCN
Hi All,
I’m a bit overwhelmed with all the PCN advice here as I can’t find anything that quite fits my scenario, so would appreciate some help.
I drove my company’s lease vehicle unknowingly onto an area patrolled by London Parking Solutions. I was stationary approx 25 seconds.
I have been caught on a camera and sent a PCN through my employer.
If it was my own car I’d declare ‘registered keeper’ but I’m not sure I can do this in this instance as it involves the lease company etc.
LPS won’t engage in an appeal despite all the info such as reference numbers and vehicle reg provided, unless I declare myself as Registered Keeper, Driver or third party respresentation; requiring written approval from the driver or keeper.
i’m fairly confident about my appeal as I was stopped 25 seconds. I didn’t leave the vehicle or get out. Was not parked. Foot on the brake the whole time (brake lights on in all photos).
Even their own evidence photos on the website showing a close up of their signage the smaller print is illedgible.
I’d really appreciate some advice on how to proceed but don’t want to identify myself.
Many thanks

Are your employers asking you to pay the bill?

Yes they are.

Can't you appeal it because you were the driver? Or are you trying to rely on them not being able to identify the driver?
Do the signs that you supposedly agreed to refer specifically to "parking". Because stopping is not parking. See Homeguard Ltd v Jopson (2016).
If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -
If this is a private (eg non-local authority or non-TFL) parking ticket then you should be posting on the parking board. ( i've asked for it to be moved)
If it's a local authority or TFL ticket you'd be better posting on FTLA - Civil penalty charge notices (Councils, TFL and so on)

Don’t declare yourself as the registered keeper if you’re not. As it’s a lease/company vehicle, the keeper is likely the lease company or company.
I’d also check exactly what type of PCN this is. If you were only stationary for 25 seconds, didn’t leave the vehicle and the signage is unclear, those points could be important to any appeal.

The lease firm has already declared you as the driver by the sounds of it, so that ship has sailed. (They have no incentive not to, after all). Some lease companies have a policy of immediately paying fines then passing the cost on to their customer (in the T&Cs) so there's no opportunity to appeal bad ones. Others simply pass on the details.
So there's no benefit to not declaring yourself as the driver. So declare yourself as the driver, then appeal it (based on stopping not parking if it was genuinely 25 secs).

The letter addressed to the lease company has been manually processed through thr system via my manager.
I do not believe any declaration of driver ID has been made by the lease firm or my employer.
Good information regarding the “stopping”. It was barely even enough time to read the sign.
Only thing is a passenger exited the vehicle whilst stopped. Does that affect anything ?The 25 seconds can be confirmed via their own timestamps on the video stills
