    Non profit - Yeh beacuse we all know non-profit companies give 100% of their profits away to charity or causes, Read the small print im sure that excludes 'expenses' or other costs - which fill the pockets of someone or some people.

    The reason its free is beacuse it encourages customers to complaint and beacuse the FOS charge each business between 250-750 for each case, so somone is paying. Its also free beacuse when the complaint gets rejected, more often then not - noone can bother go to legal route beacuse the defendant will use the FOS complaint against them in court (not that its legally binding). Its all part of the wider system - wake up people. We must start a revolution and stop these unfair practices

    So they ruled against you - maybe your case wasn't that strong. Just get over it.

    If the company has rejected your complaint and you are still within the time limit, you can refer your case to the FOS.

    It won't cost you anything and is not binding on you.

    Nothing of the sort happened, but i do have some complaints ongoing and i do believe i will have to make a choice in FOS or small claims - i dont believe FOS is a viable option based on past experience. That is it

    Yes - but read my thread, it can cost you. one of three complaints get upheld, so already you are at a disadvantage. Then if you decide to go court and take them small claims - they will bring up the FOS decision which will help sway the judge

    I genuinely don't know. It might be regulated if it is considered a pawnbroking arrangement.

    Anyway, in that thread the OP seems to be far along the legal pathway already.

    Have you actually looked at the cases that the FOS deal with? Its amazing that the upheld rate is anywhere near 35%. The problem of a free to use service, for consumers, is why not take a punt and raise your complaint to the FOS as its going to cost you nothing and it may get you some monies.

    Having seen thousands of FOS complaints there are clearly some where the bank/insurer etc has done wrong but many more are people just taking a punt. We had 2 FOS complaints that our hold music was "insensitive" as one had a skin complaint so didnt like Frank Sinatra's I've got you under my skin and the other was a widow (of several years and unrelated to their call to our normal sales line) who didnt like Achy Breaky Heart.

    Whilst the rate of cases that dont end up in court is about 97% for the County Court system, have you looked at the percentage that actually result in a payment being made? Just get over to the Parking subforum and see the dozen or more new threads each day of people finding they have a CCJ for an old parking ticket.

    The FOS is legally bound to find a "fair" outcome, the court is bound to apply the law blindly and is based purely on the arguments put forward by the parties. In many cases therefore the FOS is going to give consumers a better outcome because they dont have to blindly follow the law.

    An easy example, home insurance can be sold with Matching Set cover or without, many people buy it without because its cheaper but then when they damage one of their dining table chairs they get annoyed that their insurer only has to pay for 1 chair not the full set. The FOS has so often ruled that the insurer has to contribute 50% to the undamaged items to be "fair" that most insurers now include that as standard in their basic policy. No court in the land would have come to the same ruling when the contract clearly stated you are only covered for the items that are damaged not the whole set.

    So, if you are trying to get them on a technicality, then the courts may be a better option but outside of that then the FOS is generally the better option and it doesnt prevent you going to court after if they rule against you.

    Making your customers endure Achy Breaky Heart should be punished by the automatic loss of your right to interact with any customers ever again.
