UK-CPM Appeal After Notice to Hirer
Hi all,
I would appreciate some advice on the appeal I intend to send today in case I have made any mistakes. Here are the details
- UK Car Park Management Ltd (UK-CPM)
- Private Car Park (ANPR controlled)
- Alleged overstay on 11th July 2026 (Duration: 2 hrs 37 mins)
- Vehicle is on a long-term lease with Tusker.
- Timeline:
- 16th July 2026: PCN issued to lease company.
- 17th July 2026: Tusker issued a Third Party Authorisation Letter transferring liability.
- 18th July 2026: Notice to Hirer issued by UK-CPM.
- The Notice to Hirer was delivered without the mandatory hire agreement enclosed
I have already contacted Tusker to inform them that I intend to appeal and to ask them not to pay anything to UK-CPM and then invoice me through my employer.
The appeal I intend to send is
I refer to the above-detailed Parking Charge Notice (“PCN”) issued to me by UK Car Park Management Ltd (“UK-CPM”) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (“POFA”) and I write to formally challenge the validity of this PCN.
You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper/hirer liability for a Parking Charge. There are a number of reasons why UK-CPM’s Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular (including, but not limited to, the failure to provide the mandatory statutory documents under Paragraph 14(2)(a)).
Given that UK-CPM has forfeited its right to keeper/hirer liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (IAS), their contact details, and a unique IAS appeal reference code so that I may escalate the matter.
Thank you for your cooperation and I look forward to receiving your response within the relevant timescales.
Yours faithfully,
Thanks for having a look!

Looks like excellent research to me, covers the advice given by Edna Basher at the bottom of the first post in the newbies sticky thread in announcements near the top of the forum

I have just received a "FINAL CHANCE BEFORE ACTION" letter from CPM. It's dated 6th August though so it was probably sent out before I appealed. I have an email acknowledging the appeal submission but so far no response.

I received the following email. Note the incorrect maths about the alleged overstay!
Should I now appeal to IAS?
Thank you for your appeal against the above Parking Charge Notice.
At UK CPM we consider all appeals on a case-by-case basis. We take each appeal very
seriously and thoroughly investigate any evidence that has been provided. We
appreciate your circumstances and understand this is not a situation anyone
would like to find themselves in; however, these parking conditions have been
put in place to ensure fair usage for all motorists and support the needs of
our client. After careful consideration, it is unfortunate that I am writing to
you today to advise that on this occasion, your appeal has been unsuccessful.
The decision to uphold your parking charge notice has been made on the following basis.
Whilst we note your comments and reason for appeal, we can confirm that the
maximum stay period within this car park is 1 hour. As your vehicle was
on site for 2 hours and 37 minutes, this was an overstay of 37 minutes.
The signage on site clearly sets out the terms and conditions of
parking, including the maximum stay period. There are no exceptions to
these terms and we can therefore confirm that this PCN has been issued
correctly.
Either due to the reason for issue and/or the insufficient evidence provided to support
the details of your appeal, we have considered this PCN and found that it does
not fall under the category of Annex F the Appeals Charter of the Single Code
of Practice. Therefore, if no further evidence is provided, we will deem this
to be our final decision.
You have now reached the end of our internal appeals procedure and therefore you now
have two options; either pay or appeal to the Independent Appeals Service (IAS)you cannot do both.
To make payment of the total amount due as shown above, please use one of the following
payment options;
Online: www.paymyticket.co.uk
Telephone:
0345 463 4040 (24hr)
Post:
Payments & Collections, PO Box 3114, Lancing, BN15 5BR
Alternatively, if you do not agree with your internal appeal outcome and you wish to dispute
the matter further, as you have complied with our internal appeals procedure
you may use, and we will engage with, the IAS Standard Appeals Service
providing you lodge an appeal to them within 28 days of this rejection.
The Independent Appeals Service (www.theIAS.org)
provides an Alternative Dispute Resolution scheme for disputes of this type. If
you decide to appeal to the IAS, you will need to visit their website and use
your PCN reference and corresponding vehicle registration. All PCN's will be
uploaded to the IAS website by the end of this working day.
If you decide to engage with the Independent Appeals Service, any offer of a discount
for early payment (if applicable) will be withdrawn. Should your appeal be
unsuccessful or you chose to settle the parking charge prior to the appeal
being determined, the full amount of the PCN will be payable. Please note that
should you pay the parking charge prior to adjudication concluding, the appeal
will be closed, and you will not be given a further opportunity to contest the
charge.
If you do not wish to dispute the matter further and payment is not received within 28
days of the date of this correspondence then additional charges may be
incurred, for which you may be liable. If the charge continues to remain
outstanding, the matter may be later referred for litigation in the County
Court which could result in a County Court Judgment being made against you;
this may impact on your ability to obtain credit in the future.0 -
How lovely. Ignore them. No IAS.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
