PCN for 17 mins of parking under different circumstances
Hi all
We recently receieved a PCN from Parkingeye from a holiday Inn car park.
We were driving down the motorway when our 19 month old child was sick all down herself and filled her car seat. We left the motorway at the first exit and then the first place to stop off the motorway happened to be a holiday inn. We pulled in the car park, cleaned and changed our child and then left.
Once we got home from holiday we had recived a PCN for not paying to park at the holiday Inn. The total time in the car park was 17 mins.
When it comes to appealing do we still follow the wording in the main thread or do we tweak it to include the circumstances of our need to park, i.e child covered in sick, first exit and first/only safe place to park/pull over?
Any help/insight would be appreciated.
Side note if its relevant, the holiday Inn have stated on trip advisor, google reviews etc that they have nothing to do with the parking/any pcns that have been issued.

why do you think you're not liable? it was unfortunate, but you did park 19 mins and should have just paid.

Parking Eye will simply state that the NTK PCN letter was issued correctly, regardless of the circumstances
A judge might take a more sympathetic view, but clearly no permission to park there was sought or paid for, at the time, before leaving
Its up to the keeper to decide which approach is worth trying, OR, if its better to ignore it for now and take the chance of a court claim. IMHO, no appeal will work, the Holiday Inn car park is for the benefit of the Holiday Inn guests
Plan A is the best option here, a sympathetic landowner, but you appear to have ruled that out

Can't see what you would put in an appeal that will work with a company that only makes their vast profits out of just this type of incident, they won't have any sympathy what so ever so your story will be lost on them.
You weren't even a customer of the hotel, so they are unlikely as you have researched to get involved either.
Unless the signage or their NTK is deficient that avenue will be a dead end, and you would need photos of the signage or lack of.
@Gr1pr has basically spelled it out, unfair as it seems that is about it.
