Gemini Parking Appeal

Hi all,

received a PCN from Gemini Parking Solutions for the registered keeper which is me, however it was my partner who was driving. That’s the first issue.

Second issue is that we thought we paid for parking but poor phone signal prevented the payment from going through, which we didn’t realise until now! So my partner has no evidence that he tried to pay. It was through a QR code inside the leisure centre (sovereign centre in Eastbourne).

Third issue is that we’ve only just today received the notice because Royal Mail is absolutely shocking in our area. The notice was issued on 17th July and the letter says we need to pay £100 which is utterly ridiculous considering we just took the kids swimming for an hour. I’m not paying anything and instead want to appeal - but what appeal reason should I go with? I’ve got the template appeal letter that covers the RK issue, but should I use a different template or just flat out ignore it?

Show us the PCN so we can check if it's compliant.

If it's ok I would make a payment through the app now you're in a signal area and keep the evidence.

Then tell Gemini what happened and send evidence you have re-sent the payment. Don't "appeal" as such. Just tell them.

They won't cancel the charge and will whinge, but now you are in a position of paying late rather than refusing to pay. Makes it easier if it ever went to a court claim because you look like the reasonable one.

ah ok thank you - so pay for the parking at the leisure centre through the original method?

Hold on - remove that and redact everything about you, and the QR code.

Also need to see the reverse.

bump! Any other advice? I plan on paying the parking fee for the leisure centre and then going to Gemini to explain. However I’m running out of time to appeal because of the post delay!

You aren't running out of time and they almost certainly didn't post it on the day it says and probably used a mail consolidator (a middle man firm which adds a week) and even second class post.

It's not the Post Office at fault for a NTK supposedly dated 17th July arriving on August 4th, well after the discount expired. A cynic might say: deliberate, innit…!

And that's very clearly a non-POFA PCN because it has no wording from para 9 of Schedule 4 of the POFA 2012 in it. Therefore the keeper can't be held liable so obviously the KEEPER appeals, telling Gemini to go swivel. They could have used the POFA but didn't. Their choice, their loss.
