Fighting Horizon Parking Fine - Input appreciated

Been and read through dozens of forums, success stories and advice. I 'may' have this in hand but i'm willing to listen to any advice or input, i've got a feeling i've been too honest / too much information provided to Horizon Parking - the main one that helped me was this;

Looking at land owners etc was a massive help.

Anyways, I was at a Travelodge Hotel which has parking managed by Horizon, I got there and paid for 24hr parking, had a boatload of issues with the hotel (hold with me this may seem irrelevant information but it ties in) used the parking for an hour and then left for an event. Got back many many hours later and found that there were no available bays to park in (blue badge holder) so because of my disability I pulled up and let my partner run in to see if there's any other parking arrangements or what they can suggest (their suggestion wasn't helpful and didn't assist me at all)

I was sat in the car with the engine on waiting for my partner to go ask questions and come back with information, gets back to the car and dispute unresolved. End up leaving said hotel due to said dispute and going elsewhere, I was 'observed' for 12 minutes and the fine was for being parked not in a marked bay' to which I know there's loopholes and such about what is deemed as parking and what's not. I appealed this to Horizon and give them a very very in depth timeline and explanation of the reasons I was waiting where I was (outside of a marked bay, slightly on 2 red lines) and they basically said 'although we can appreciate you were in a predicament that's not a valid reason to be parked out of a bay'

I've since went back to Travelodge and complained stating that because they own the land and it's through them I was in that predicament waiting and had to park there because of lack of facilities etc. etc. that they either get the PCN cancelled by Horizon or i'm reimbursed for paying it.

They've then since asked for a copy of the PCN and i've heard nothing since (granted it's only been a few days), has anyone had any experience with this kind of thing, does anyone have any advice regarding my situation, i'm sorry that it's all over and a bit janky of a story and typed out but without giving too many specifics away but i'm hopeful that Travelodge will sort this for me and I don't have to worry, outside of this I don't know where I stand.

Thanks in advance!

    Definitely wasn't a fine, magistrates issue fines, not private parking companies !

    It was a Parking Charge Notice, PCN , an Invoice

    Plan A is definitely your best option here, that complaint to the landowner, the hotel, especially if the Equality Act 2010 applies, reasonable adjustment, extra time etc

    Have a read of the Premier Inn , Whitbread thread lower down the page, ( cancelled by Whitbreads, eventually )

  • That's a good way to look at it, hopefully my invoice gets disregarded then. I need to look further into what applies to me from the Equalities Act 2010 (should be more clued on it) but any insight or forum posts that would be helpful or even just knowledge you possess is greatly appreciated.

    For now I'll wait to see what Travelodge come back to me and say, with everything that went on I think they may because the entirety was a shambles for me.

    Any blue badge holder is covered by the Equality Act 2010 ! So it covers your disabilities !

    The blue badge is just a "permit" showing your entitlement etc

    Its the LAW that covers your circumstances, contracts, reasonable adjustment etc, that law is mandatory on service providers, that law being the Equality Act 2010, so you use the law against transgressions, not the more insignificant blue badge of entitlement

    And you never mention the legal word , fine.

  • Honestly didn't even read the date at the time, i'll see what Travelodge come back with but fingers crossed with them asking for a copy of it they're just going to sort it. I am wary of them taking too long and causing me further issues potentially though I imagine arguable if they've asked for a copy

  • Update on this one, the parking charge has now been cancelled by Horizon, happy days!
