Faulty Parking Eye ticket machine
Almost 4 years ago I parked and encountered a Parking Eye ticket machine for the first time in my (then) 77 years. I followed the instructions but on attempting to enter my registration got no response from the machine. I then tried to pay anyway thinking a valid ticket was all I required. I only used half the time I paid for.
Parking Eye claimed that I breached the contract and a fine was payable. POPLA upheld their claim. I claim that the problem was their faulty machine. Now, less than 2 months short of 4 years since the event they are threatening court but will accept £100 as payment instead of the £170 they have been demanding for at least the last 2 years.
I still have the ticket that the machine issued showing my attempt to enter my registration but it cuts no ice with them. Should I pay or fight on?

Is it PE asking for that, or DCBL on their behalf?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
