Euro car parks queries & POPLA appeal draft for feedback
Hi all, my husband received a NTK from a euro car parks car park in Clacton. The car park doesn't belong to a retailer so we sent off the template from the 'NEWBIES' page (thanks to Coupon-mad).
Like another poster on the forum, the machine played up a few times but my husband eventually received a ticket but didn't realise it was a 'void' ticket.
Their response advises that the parking charge is still payable.
I've seen reference to '8 steps' on here but I can't find them so I can check what I need to do next. Can someone point me in the right direction please?
Also I read, 'Euro cases all end up with DCB Legal, who make court claims and then discontinue.' from 2025. Is this still the case and do I still appeal through POPLA?
Lastly, my husband is chartered accountant and he would be open to investigation by his governing body if he gets a CCJ so I'm in two minds whether to just pay the £60 even though it grieves me.

Contact the local MP, they might be able to help. Oh hang on….
By the way, a CCJ paid within 30 days doesnt stay on any record.

Thanks for your post, and also the info re a CCJ.

There’s zero risk of a CCJ if you follow the advice.
There’s also virtually zero risk of paying anything if you follow the advice
DCB Legal usually do discontinue but you’ll have to take a few steps over the next few months. Nothing major and nothing that hundreds of others haven’t done

The recipient could make a complaint to the CMA about it, especially because they are currently investigating ECP for issues like yours
If you and he follow the advice on here, there won't even be a hearing, let alone a judgment, so definitely no CCJ as long as no paperwork is missed, so rest easy

Thank you.
Can you tell me where the 8 points of advice to follow are located?

Although you'd have to ignore a claim form to have a default CCJ issued against you, I would strongly recommend you transfer liability to yourself so that your husband becomes immune, no matter how tiny the risk.
There should be instructions for how to name yourself as the driver on the PCN. Presumably the address will be the same, but that's fine.
They will then send a Notice to Driver to you to ignore.
Have a look at the Discontinuation thread - 75% of them are Euro Car Parks 🤣

Thanks, Car1980. I'll speak with my husband about transferring liability.
Is this the Discontinuation thread? https://forums.moneysavingexpert.com/discussion/comment/82082413#Comment_82082413?utm_source=community-search&utm_medium=organic-search&utm_term=discontinuation

Thanks, Gr1pr.
Just so I'm clear, is the 2nd post in the newbies sticky thread the one headed Post 2 SMALL CLAIM? I've only received the first letter from euro car parks with the POPLA number. Do I go through POPLA first?
I can't find the defence template. Are you able to help me locate it?

You don't need a defence (you aren't being sued yet) if you are merely at tedious and fairly pointless 'appeal' stage!
And nobody is risking a CCJ, so slow down!
I'd simply ignore them now (or try POPLA to see if they back down) and fight back by sending your evidence of the misleading 'void' ticket to the CMA. They DO NOT help individuals but they are collecting evidence.
Euro Car Parks could be fined because the CMA have opened a formal consumer protection investigation into them specifically. Did you miss that news?!
Read it NOW. 😀
Now is the time to alert the CMA to every unfair ECP case here. We should no longer ignore ECP, we should ALL push them into a hole!
This investigation has only just opened - days ago - and they are calling for evidence about matters including that firm's conduct surrounding appeals.
Nothing to stop you trying POPLA stage (BUT DO NOT PAY EITHER WAY) but do send your evidence of that misleading ticket and ECP's appeal rejection to the CMA.
CMA Contact emails (use both, the first one goes directly to their parking investigation) :PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
