    What about the difference it could make to the care your father receives in his declining years?

    There is no time limit on DDoA and 5 years is not that long ago. Be prepared for a fight or to give up some of you inheritance to make sure your father gets the best care possible.

    From personal experience I know how difficult it is to obtain good quality care at the time you really need it if you are not self funding and will never allow myself to be put in that position.

    If you made the transfer using POA rather than him doing it himself then that was not acting in his best interest and way beyond your authority as attorney.

    Yes don't think for 1 second that what's best for my dad isn't my number one priority as it is.

    I'm just trying to get as much information ahead of time to make life easier potentially down the line. Ironically which is exactly what our thought process was with the trust.

    My dad does have carers into visit him 4 times a day at present organised by myself which is 100% self funded. I'm purely trying to gather information at present.

    I fully understand that and if that was the case I would of course put him in a home.

    My dad does have carers into visit him 4 times a day at present organised by myself which is 100% self funded. I'm purely trying to gather information at present.

    My dad has always said (and still is) that he'd rather be in his own home with carers coming in.

    Would live-in carer be a suitable option over a care home?

    For domicillary based care the home a person lives in is not used in calculations for funding eligibility. Although there may eb a contribution (compulsory) to be paid.

    I do know for older folk councils tend to opt for care homes rather than care at home but they are meant to make the decision based on the persons best interest.

    I already have PA/Carer support so know as I age I am likely to need a care home but my plan is to stay home as long as possible and my younger family are aware of my hopes and to fight for care in my home.. however i also see our home as a way to buy decent care home for 'last person standing' out of myself and husband.. anything left then goes to family.. its sort of our insurance policy. But for me care at home is my preferred option.

    It may be that a way to ' keep the house' is to look into eligibility for care at home/ live in care if his needs would allow.

    It is best interests, but judicial review cases have said that local authorities can also take cost into account as well.

    it’s a little more complicated than that, but cost is also a relevant factor. They simply can’t afford to pay for everyone to be at home with 24 hour care, when the level of need becomes that high.

    All shall be well, and all shall be well, and all manner of things shall be well.
