Retail park parking charge

I’m after help please

I’ve spent a while trying to find the owner of the retail park to go down plan A. Came across parkplaceretail who say they can’t help with parking fine. And the property investment fund who own the place… not helpful either. As well as another management firm who weren’t helpful. Can’t get through on phone to any of the shops, could always call in some point this week…

Anyway, charge states overstayed by 26minutes, have bank proof I spent money in 5 shops on the retail park. Very difficult to spend less than 3 hours there with 3 kids under 2 years old and having lunch out!

Here is a picture of the parking charge

The car is leased, so don’t want to get charges from lease company. This is the first correspondence I have received. Noticed it has taken a while to be issued.

I’d like the best chance of overturning as possible, so before I appeal and tell them why I spent over 3 hours. I’d appreciate any extra pointers, cheers

Follow the advice by Edna Basher at the bottom of the first post in the newbies sticky thread in announcements near the top of the forum, appealing as the hirer

No blabbing about who was driving or about what happened either

I doubt that GN included copies of the lease document, meaning no hirer liability

Yes, I have read the stickied post multiple times. Brain is frazzled hence the post.

I will send an appeal later using parts of the one size fits all template.

Do I fit in about proof of purchases and having young children or is this too much “blabbing”?

Do not add any background information to the appeal, because the hirer is appealing on the basis of no hirer liability ( not about the circumstances, not about what happened, not about how much was spent, not about how many shops or businesses were visited, and not revealing who was driving either. ), but about no hirer liability under POFA ( only. )

You aren't using the blue text one size fits all template either

Just read the bottom section only, about lease and hire vehicles, and the Edna Basher templates ( only. )

Hi, I appealed using the Edna basher template and involved no background info. They rejected and gave me a popla code. Will send correspondences below. 1st image is my appeal and 2nd is their response. Advice is much welcomed please

Either read POPLA Decisions from the latest post, skim reading back (pages and pages) until you finally find a winning Hirer appeal to copy from,

    Or

    Search the forum for:

    POPLA hirer paragraph 13 appeal

and skim-read the search results until you finally find one.

Bear in mind that the hirer appeal to popla majors on the following

    Driver not identified

Pofa2012 not complied with ( no hire or lease agreement included with the NtH. )

No transfer of liability from the driver to the hirer ( or lessee. )

No liability as the hirer ( or as lessee. )

    No landowner authority

    Etc

So its not about what happened, its all about no liability as a hirer or lessee for whatever the mystery driver did or didn't do, mainly due to GN not fully complying with the law. ( Pofa2012. )
