2nd Letter Before Action - 9 months after I responded by email
i have received a 2nd Letter Before Action from Civil Enforcement - 9 months after I sent an email response to the first one following the Newbies thread guidance.
Do I just send the same email as I did back to them again? I got no response last time, or do I now have a different defence?
—Sent 24th Sept 25——
Proposed Legal Proceedings
Claimant: Civil Enforcement Limited
I refer to your letter before action.
I confirm that my address for service for the time being - assuming you don’t delay any claim - is as follows, and any older address must be erased from your records:
etc….
Thanks in advance for any guidance

I probably wouldn't bother. You are not at the stage yet where you need to think about a defence

I thought you were not supposed to ignore these?

I gave my details to AI and it is recommending that I don't ignore or send the same response but highlight that they ignored my previous response.
Let me know your thoughts - nervous about doing the wrong thing.
I was thinking I maybe don't say the reason at this stage.
It also said to file a SAR but would think hat might just !!!!!! them off!
Subject: FORMAL RESPONSE TO LETTER BEFORE ACTION – Charge Ref: [Insert PCN/Ref Number] – CLAIM DISPUTED
Dear Sir/Madam,
I refer to your Letter Before Action dated [Date on the new letter] regarding parking charge reference [Insert Ref Number].
1. Unreasonable Delay & Pre-Action Breach
I formally responded to your previous communication on [Date of email 9 months ago] (copy attached for reference), explicitly disputing the charge and confirming my correct address for service.
You failed to address my representations, ceased contact for 9 months, and have now re-issued a duplicate Letter Before Action without responding to the points raised. Restarting the pre-action process without responding to my prior correspondence is a breach of the Pre-Action Protocol for Debt Claims.
2. Status of Claim & Address for Service
Liability is denied in full. For the avoidance of doubt, my address for service remains:
[Your Full Name]
[Your Current Address]
You are instructed to update your records immediately. Should you issue court proceedings to any former address without checking, I will seek to have any default judgment set aside and apply for full costs on an indemnity basis.
3. Summary of Dispute
As outlined in my previous correspondence, I dispute this charge on the following grounds:
- [State main reason, e.g., "Lack of landowner authority to issue claims in your own name."]
- [And/or "Inadequate and non-compliant signage at the site, incapable of forming a contract."]
- [And/or "No keeper liability established under Schedule 4 of the Protection of Freedoms Act 2012."]
4. Next Steps
Please confirm in writing within 14 days that this matter is now closed. Alternatively, if you intend to proceed, you must provide full particulars of your claim, the contract demonstrating landowner authority, and all contemporaneous photographic evidence.
Yours faithfully,
[Your Name]

@munerz_95 Arrgh! 🤬🤬
Please DON'T use AI for any of this!
Please stick to the resources on this forum because AI is less useful than breasts on a fish for dealing with this.

Email the template LoC Response to CEL, 5 minute job, job done, no need to faff around, because its a nothing stage
Then wait for the inevitable N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the post in due course
