SIP Parking Notice

Hi all,

Looking for a bit of advice.

A little while ago I received a £100 Parking Charge Notice from SIP Parking. I've now received a "Legal Action Imminent" letter saying I owe £160, with the extra £60 being described as overdue payment damages.

I'm going to be a little vague on dates and the exact location as I've seen people suggest not posting anything too identifiable on the forum.

This relates to a SIP car park in Manchester that I use regularly for work, probably around three days a week. It's one where you can either pay at the machine or via the app. I tend to use whichever is quickest, although the machine is slightly cheaper.

On the day in question I definitely paid for 12 hours of parking, and I was parked for considerably less than that. I have the time stamped payment showing on my bank statement, and the letter stating the date of the offence. This period was much less than the 12 hours, so I was well within the time I'd paid for.

I genuinely have no idea why I received the PCN. The only explanations I can think of are that either their system didn't register the payment correctly or I made a minor keying error when entering my registration.

I ignored the original notice(s) and have only now received this "Legal Action Imminent" letter.

I am not entirely sure of the next steps as I don't want to scupper any chances of properly defending this. What would you suggest my next steps for me are.

Thank you

Wait for the Letter before/of Claim first, then respond but not with the template LBC response.

In your case, reply to the LBC telling the story, showing your evidence and suggesting it was (at best, if anything) a minor keying error and the PCN should have been picked up and matched the payment with early human checks to prevent automated decision-making from issuing a wrongful PCN.

Tell them you'll report SIP for investigation by the ICO and the CMA if they fail to provide the VRM logs to show the payment and to either cancel the PCN or explain why it was issued, if not a keying error.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
