Difficulty removing CCJ after Ombudsman case
Hi,
I had a CCJ applied against my name without my knowledge for a debt that I then disputed. The case went to the Ombudsman who ruled in my favour and I was told I would receive GOGW payment and the company would contact the credit agencies to have the mark removed within six weeks. However, this has not happened and the Ombudsman don't seem particularly interested in following this up. Is there anything I can do?
Full details:
- I was with Scottish Power (SP) for about 2x weeks in 2020 when my supplier, Tonik Energy went into administration
- I informed SP that I would be moving address and supplied them with my forwarding address. They advised they would close my account.
- I was in credit with Tonik Energy who advised that SP would issue me with a refund in due course due to my move.
- I contacted SP a second time, provided them with my final meter readings and confirmed forwarding address again.
- Unbeknownst to me, SP didn't close my account and continued billing my account at my old address. They also sent chase letters to the old address.
- After some time SP sold the 'debt' on to TM Legal, who also chased me at my old address.
- After a period of time a CCJ was raised against my name for about £470.
- I then moved address again, and apparently the CCJ details were then sent to that address.
- Eventually, TM Legal tracked me down in 2025 and threatened various actions, and I learn of this supposed debt and the CCJ in a phone call with them
- I explained the situation and provided proof of correspondence with SP and they agreed to cancel the debt. They also sent me an email saying they would contact credit agencies to reverse this.
- They also said I would need to speak with SP as they would need to contact credit agencies as well.
- I contacted SP for information and to complain and they refused to speak to me.
- A number of weeks later I reraised a complaint via email and advised I would be going to Ombudsman if they didn't speak with me
- The SP complaint response team kept delaying and trying to charge me money so it eventually went to the Ombudsman
- The Ombudsman eventually ruled in my favour and I was awarded an apology letter, a reimbursement of the money I was owed from my account and a GOGW payment of about £125. SP were also instructed to contact the credit agencies and I was told to wait six weeks.
- SP repeatedly sent the payments to the wrong address, for the wrong amount, cancelled the cheques and generally tried to obstruct as much as possible until that was finally resolved.
- Ombudsman lost interest at this point and stopped responding, advising that SP had informed them they had contacted the various agencies and fulfilled all resolutions.
- I recently had to apply to move address (many months later) and the CCJ showed up on my account again.
- I asked the company that performed the credit check for more info but they declined to share.
- I contacted the Ombudsman again and they advised it would be a new issue and are now ignoring my messages again.
- I have reached out to CAB for advice on what to do.
Thank you if you have read this far. It has been a long and drawn out process and I am still unsure of what steps I should be taking. I had thought proving I owed no debt to SP and the Ombudsman would be the end of it, but here we are. As the Ombudsman seem to want to wash their hands of this matter, any advice would be gratefully received. I do not know anything about the CCJ, which court issued it or if I need to speak to them directly. Please excuse any naivete on my part and any advice on what to do would be appreciated.
Thanks,

A "formal" complaint about the competence of the Ombudsman appears to be the next step.

There are only three ways a CCJ can be removed from a credit file, they are:
(1) If the debt connected to the judgement is paid within 30 calendar days of the judgement being issued
(2) If you are successful in a set aside application, either by consent or otherwise
(3) If six years have passed since the date of judgement, the entry is automatically removed from your file.
To my knowledge, there is no other way to remove a county court judgement from a credit file, so you would have to apply to have the judgement set aside, by consent of the company whose favour the judgement was granted in the first place.
That would require you to follow these instructions:
Set aside by consent court form
To set aside a default judgment by consent, you can follow these steps:
- Complete the N244 form: This form is used to ask the court to set aside a judgment or vary an order. It is the standard application notice used in county court and High Court proceedings in England and Wales.
- Provide reasons for the consent: Explain why the default judgment should be set aside, such as the claim was not properly served or the defendant had already responded.
- Include supporting documents: Attach any evidence or documentation that supports your application, such as bank statements or other relevant documents.
- Pay the court fee: The fee for applying to set aside a default judgment by consent is currently £119.
- Notify the court: Send the completed form and any supporting documents to the court.
- The next step would be to re-claim the set aside fee from the judgement creditor.
