N1SDT claim form — defence help needed (NCP/Moorside Legal)
Hi all
I'd really appreciate some guidance.
I've been sent an N1SDT claim form and wanted to double check some things with my defence. I have read and re-read the newbies thread but I am having issues with assimilating information at the moment so I want to make sure I don't miss anything that could harm my case. I have included details below and then my question below.
- Claimant: NCP (Solicitors: Moorside legal)
- Date of offence: 13/01/2026
- N1SDT issue date: 15/07/2026
- AoS via MCOL: 20/07/2026 I will file this today
Background:
- The PCN letters were originally sent to my old address as I did not update my V5.
- In March 2026, they found my new address and when I received a letter from Moorside Legal, I did the wrong thing and called them - they of course told me it was my responsibility to update the V5 so it remains as is.
- I updated my V5 immediately.
- I then (probably wrong thing to do again) ignored any letters from them and did not retain any.
- I then found this forum.
- I have now received the N1SDT claim form which I intend to file the AoS today but I am thinking about my defence, the particulars of the claim is as follows:
- The claim is for an unpaid Parking Charge issued for a breach of contractual terms on 13/01/2026 at [X location] to vehicle [X reg]. The signage displayed at the site set out the contractual terms and offered a contractual license, which the Defendant accepted by parking. The Claimant has no authority to operate the site and issue charges. The breach was: Parking without payment of the parking charge. the Defendant is liable as the driver and/or keeper, in contacts and/or pursuant to POFA Sch 4, and the charge remains unpaid despite demand. AND THE CLAIMANT CLAIMS 1. £170.00 being the total pf the PCN. 2. Costs and Court fees. The claimant claims interest under section 69 of the County Court Acts 1984 at the rate of 8% a year from 10/02/2026 to 13/07/2026 on £170.00 and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of £0.02.
I understand I know send the defence that has been drafted in the newbie thread and add my own words but do I admit to parking without paying and then when they sent an 'invoice' it was sent to the wrong address because I didn't update my V5?
I know you receive multiple of these so thank you in advance.

Do not admit to anything in your paragraph 3
Just use a generic paragraph 3 that refutes the POC, same as in dozens of similar cases on here over the last 12 months
Ps, there was no offence, just an alleged breach of the parking contract on that private property
Do not mention not updating the V5c , less is more at this early stage

Thanks for the clarification. I have drafted my defence below, is this sufficient? I forgot to mention in my original post that I didn't pay for parking as I forgot - it is my usual car park for work and it was a genuine mistake. Even with that, I am assuming I refute the POC in its entirety?
Using template para 1 and 2.
Para 3: The Defendant denies that the Claimant is entitled to the sum claimed, or any sum at all as the Defendant does not admit that a valid and enforceable contract was formed between the parties as set out below. There can be no 'keeper liability' in this case. Research has proved that this Claimant has rarely used the provisions of Schedule 4 of the POFA 2012 and they know, or should know, that they cannot hold registered keepers liable.
Using template para 4 - 10
Para 11: The Defendant notes that National Car Parks Limited entered administration on 16 March 2026, with PwC appointed as administrators. A company in administration cannot commence or continue litigation without the express permission of the administrators. The Defendant puts the Claimant to strict proof that the administrators have specifically authorised the continuation of this claim and that Moorside Legal Services Ltd have been expressly instructed to pursue it on behalf of the administrators. In the absence of such proof, this claim should be struck out.

Hello, I have received a letter from Moorside Legal offering me a 'Settlement proposal' if I pay within 7 days of receipt of their letter. The letter states if the claim is not settled then their client intends to proceed with the Claim. I would rather not pay for their still extortionate settlement proposal (£150). I'm not sure what to do now, can you advise please? To add to this, I'm off on holiday tomorrow and wont have signal for 2 weeks so I really need to action this now (if there is any action). Thank you.

Has no one noticed this in particulars of claim in post 1?
"
The Claimant hasnoauthority to operate the site and issue charges."They are admitting that they do not have authority to make a claim against you, or is that a typo, or have I misunderstood?
