Hi,

I bought a car through the VW Used Approved Scheme about 4 weeks ago now. The car developed a fault which was assessed by the local VW garage to be due to a botched repair by another VW garage earlier or this year (before I bought the car) . The local VW garage got the car into a drivable state and then the selling dealerships advised they would come to pick up the car later this week to repair and give me a replacement car . In the meantime , the car broke down again on Friday due to the same problem and then the car was recovered by to the selling dealership (a long distance from me). VW assist refused to give me a courtesy car due to the fault being repeated and non-warranty and the selling dealerships could not get a replacement car to me or authorise anything else as they had no staff around who could do that. I have now been without a car for 3 days and need a car for my healthcare work , do I have rights under section 75 (the car was partly paid for on my credit card) to get a hire car or similar solution until the selling dealership can get a car to me ? Thanks

    There is no legal requirement for a dealer to provide you with a "courtesy" car unfortunately. However depending on how you deal with the site then you can appeal to their generous nature.
    

    Did you finance the car through VWFS? If so then get an official complaint registered this morning with them and explain what's happened and they will push the dealer to take action, although franchised VWFS have leverage over the sites.

    If it was within 30 days then reject the vehicle? sounds like you are past that so now need to go through FOS to reject the vehicle.

    Why did they say it was non-warranty? Its not a DPF issue is it?

    What is the fault?

    What is required to repair the car, given you say that is your preferred outcome?

    It sounds like you may be able to exercise the short term right to reject, given the fault first arose within the first 30 days. Expect significant push-back on that.

    AIUI, S75 will not obligate the CC to provide a courtesy car as the Dealer is not obliged to provide you a courtesy car.

    Your rights against the credit card under S75 are the same as against the retailer.

    • Within 30 days, there's a short term right to reject.
    • Alternatively, you can ask for a repair, replacement or refund. But the retailer may reject your preference and do one of the others if it's too expensive for them.

    There's no actual right to a courtesy car. They only have to do the repair in a reasonable time.

    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    If any finance is involved. You would only end up at FOS after either 8 weeks or if a deadlock letter is issued before. if you do not get any action from lender. Even then you are looking at months before FOS will look at case.

    Any courtesy car is down to dealer working on the car as most warranties do not provide one.

    You say the car is essential for your business ('I need a car for my healthcare work'). The CRA is not really designed to meet your requirements, indeed this might disqualify you as a consumer under the Act.

    In future you might be better with an appropriate business lease of a vehicle which guarantees an immediate replacement if the vehicle lets you down.
