the water supply pipe to the upstairs flat runs external, which i found surprising as i thought you can't have a fresh water supply pipe run external and that it had to be at least 1m below the ground.

I would suspect that as there is no water meter at present, it will be a fixed charge to begin with. However in some areas, the WB will force the use of a meter eventually, if it is classed as an area of water stress.

i hope so. but if they insist on putting in a water meter then we will argue that it can't be read properly because of the shared supply, and sure, if they want to spend money separating the supply they are welcome to do so. or they can fit an internal meter like they did for the neighbours upstairs, but there isn't much room under the sink where the stopcock is, so fitting a meter won't be easy.
