Confused as to next Step??
No fault car accident October 2024….Hit from behind.
I had a number of complications which were confirmed in a Medical Inspection shortly after the accident.
Months later I got an email from my Insurance saying the guilty partys insurance were offering me £4000 for the damages.
I rejected the offer explaining that I didnt think it was enough for the pain I had suffered.
I have now reached a hiatus with the Companies ( My Insurer Esure/Minster Law His Insurer Hastings.).18 months later and there has been no progress.I have offered to have an Mri Scan if required.
I am concerned that this may run into the time limit (3 years) that insurers have on settling cases.I kept a copy of the Email that the Insurers sent me of the £4000 offer.
Could I ask what you might do in this situation please??

Can you quantify your suffering in any way? Days missed from work? Meds costing £X required? Travel to/from doctor appointments or the cost of the appointments themselves? Missed holidays? Other missed opportunities??

I was hoping for £6000….I am still having problems with pains in my back (particularly).

Im not the type to fabricate things.
This happened just as I retired …all other costs and losses were very nominal

Were you fit and healthy before the bump?
Any pre existing ailments to your back area that have been seen by a GP or A&e and would be better on your medical records?
As mentioned before what actually losses can you back up with evidence.
Also who conducted the medical inspection?
I would just take the money offered and then get on with your retirement.

No pre-existing ailments.It was a Doctor specifically assigned to accidents(at their request).No tangible expenses to recover

In that case take them up on their generous offer as nothing pre existing to hold you back and it's not worth dragging it out any longer.

Without having any way of quantifying the situation then you are dependent on them making a reasonable offer.
That said - there's no harm (I think) in turning down their offer and saying you want double or some other amount and seeing what they say.

So its whiplash then?
For a good few years now whiplash is a defined tarriff and massively lower than they used to be before the government changed the law. £4k would be fractionally under the rates for a whiplash that the doctor declares will last up to 2 years, they've gone up now but the base value will be based on the date of loss.
Its really your insurer appointed lawyers you need to be talking with, they are ultimately the ones to advise you and its their opinion your insurers will take on board if there is a decision to litigate because the offer is too low.
