Mears Failure to Deliver Vacant Possession
I'm having issues getting my property back after giving them the required notice.
17 January 2024
• Lease entered into between the Claimants and Mears Housing Management Ltd.
• Lease term: 2 years plus 14 days.
1 December 2024
• Glenroe Living Ltd subsequently stated that the lease had been assigned/transferred from Mears Housing Management Ltd with effect from this date.
• No deed of assignment, novation or landlord consent was provided to the Claimants.
3 January 2025
• I became aware that Glenroe was managing the property.
• I queried the transfer with Mears.
7 January 2025
• Mears confirmed in writing:
" I will need to contact the new agent who is managing your property."
January 2025 onwards
• Glenroe collected/administered rent and dealt with property matters.
• I continued to seek clarification regarding the alleged assignment.
3 January 2026
• I served notice terminating the lease pursuant to clause 9.3.
• Vacant possession required by 1 June 2026.
13 January 2026
• Glenroe acknowledged receipt of the notice and stated it was liaising with the local authority regarding the occupier.
January 2026
• Property placed on the market for sale.
26 May 2026
• I served a Final Demand for Vacant Possession on both Mears and Glenroe.
• I requested details of any assignment and any possession proceedings.
27 May 2026
• Glenroe stated:
"The local authority confirmed they are going through the legal process for possession back of the property."
1 June 2026
• Date for delivery of vacant possession under the termination notice.
After 1 June 2026
• Vacant possession not delivered.
• Property remains occupied by a council-placed occupier.
• No assignment documentation has been produced.
• No possession claim details have been provided despite requests.
10th June 2026, I have filed a N5 & Particulars of claim with Barnet County Court, but apparently they are very slow in processing.
any further advice would be greatly appreciated
