Received this is the post last week, filed AOS today
, will file defence over the next two weeks.
Is it still the case Gladstone's usually drop proceedings before court?
TIA

Its up to the client, not Gladstones, but I read a lot of cases on here and I would say that their clients tend to go to a hearing

thanks, are my timings correct for filing defence?

At the moment, yes

Do you know what the amount of the charge is stated on the signs (contract with driver)?

As the breach is stated, just use the Template Defence with your own paragraph 3 facts / denial of liability but do first double check the Horizon PCN. Was it £100? Gladstones / Horizon often add an unlawful £10 every time.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Within Para 3 should I add in the facts of my case ie
- Late arriving to the hotel 23:56 (don’t have paperwork to hand for exact time as at work but can check later)
- Don’t recall but think you had to enter your reg into a tablet for parking, or pay
- I spoke with the receptionist the next morning when I left as I did not enter my reg / pay for parking, (don’t recall, maybe tablet not working but cant guess incase wrong) I provided by VRM and she said she would sort it out
- I have received the PCN which I ignored and the reminder letter
- Now have the CC claim

Save all that for the proper stage, the WS stage in several months time

No you'd simply deny liability because the only contract was with Premier Inn. During the Defendant's hotel stay, their recollection is that the tablet to exempt numberplates was not working when it was tried, so an alternative contract was agreed with the hotel: in good faith the Defendant gave their VRM to the receptionist, who promised to input the data herself, to exempt the vehicle for the total stay. Thus, nothing the Defendant did was in breach of any any 'relevant obligation or relevant contract' and in fact the arrival time was close to midnight, in pitch black and rain, so no Horizon terms or signs outside were 'bound to be seen' so the Supreme Court authority is distinguished. Further, whilst the terms were inadequately displayed in the dark and were not seen, the PCN sum stated on the sign is not believed to be £100 (if it was, it was in minuscule text) and there was no agreement to pay that, let alone £170.
(Are you SURE the signs said £100)?
