Delivery driver forged my signature and left in an unsafe place

I purchased as item online and the postage which had to be signed for costing £6.99

FedEx sent a message re date and time of deliver. It hadn’t arrived so I checked online and it was delivered before the allotted time.

I have 24 hour serveillance cameras no one had set foot on my property.

I called the company I purchased the item from she confirmed it had been delivered and there was my initial and a squiggle as signed for but they would investigate.

The next day a man walked onto our property and went to an old unmarked large wooden gate where he had stuffed it under and behind a bbq we haven’t used in years. My drive is about 150 meters round the corner. So I do have the parcel. No apology or explanation.

The supplier states they re not responsible for the delivery company and both (FedEx ) refuse to acknowledge my complaint, they both will not provide a copy of my signed delivery notice or refund the £6.99 I paid for my signature. I have sent more than a dozen emails to both parties .

A man from FedEx did call me on an no caller I’d or visible telephone number (some weeks later) but I did not pick up due to the number of scams especially high rate calls. I emailed him straight away as I was abroad and unable to take his call but contact me after 28 June of course he never called back.

My concern is that someone could have taken the parcel and I would not have a leg to stand on as it had been ‘signed’ for.

As I have no evidence of my signature but - if correct I think that’s quite serious Or who can I complain to?

It's becoming increasingly common that parcels are 'fake' signed for and/or left in the wrong location. Most companies will now refund or send a replacement.

You're really not going to get FedEx and probably not the sender of your parcel to care so, as you have the parcel, you may be best just letting it go.

The supplier is legally obliged to make sure the parcel gets to you so they're not entirely lacking in responsibility for the courier but FedEx are a fairly reputable company and there aren't any couriers who this hasn't happened with. I can easily name half a dozen that I've had personal experience of.

It's frustrating, but you got the parcel safely and you've flagged the issue to FedEx so I would leave it at that.

It happens all the time, it's really common. That doesn't excuse it in the least but it does mean they can't be bothered to do anything about it. It's a sad state of affairs

But nobody did take your parcel.

    You have it.

I appreciate your frustration but you've tried to complain to the supplier and the courier and have got nowhere.

There are things worth fighting for but I don't think this is one of them.

I don't think a squiggle counts as a forged signature.

Also there has to be an intention to decive for a fraud conviction. As the parcel was left with you I don't think that applies either.

If you read the terms you may find that it requires 'your' signature rather than 'a signature' which could give you grounds for a refund for the difference in price between a regular service and a signed-for service. However, even if that is the case the person that sent the parcel will have to make the claim rather than the person who recived it and I doubt they would be interested if its actually been delivered.

You seem to contradict yourself there… you say no one had been on your property but then state the parcel had been put onto your property by the delivery guy.

Signed for 99% of the time is a waste, personally much rather have a picture of where it's been left as that easier to play the "where have they hidden it this time" game. I worked out where the Mrs medicines were because I recognised the reception where they'd been delivered and only then realised the address on the prescription was a blend of our old and new address (only 100m apart).

We often get things "left with our receptionist" according to Amazon, 95% of the time that means our next door neighbour who has gotten to refer to himself as our receptionist now.

These arent new problems, in early 90s in my first job as a mail order company we forever had people calling up saying they couldn't find the parcel in the "safe place". Technology does help track them down though more. Had more than one case where "safe place" had been listed as "in the bin" and the inevitable happens though that was the customer giving the instruction and our agent putting it on the record. Wasnt much point blaming the courier as we owned them so.

I have a very safe place for leaving parcels and most of the regular drivers know where to leave it. DHL rang on yesterday to tell me that they're about to go back to signed for. I'd guess this is related to their Evri partnership. It's said DHL was to be rebranded as 'Evri Premium', not sure if that's still happening.

  • yes I did say it had been put under an old unused gate not used for decades and but not visible to my 24 hours serveillance because it was hidden . I did search and looked on the main roads outside our property 150 metres to my drive clearly showing a number and name. Sadly that person did not look for my address clear.y marked.

I do blame the courier although I do appreciate they are under a strict time scale - which should not be happening.

the problem is customer services - deliveries to mention a few are getting away with it. Some suggest it normal so forget it!…. I am of a certain age and seen the lowering of standards and acceptance of crime. Why should I?

A crime is a crime and should be dealt with accordingly. There are no excuses. Some people don’t and that’s why a fear for my children and grandchildren’s safety.

Stand up for rights, security and protect the elderly and vulnerable…. I’ve seen the changes over the last 60 odd years and can not understand why some are so excepting.

  • You would say I was lucky. But what If someone had taken it! People say happens all the time. Social media is full of it some never finding the missing items … someone is gaining from that! Why should I !

If a delivery person can not find the address don’t think about it and stuffed it under a gate on a main road round the corner from my house. I don’t consider myself lucky! The more we challenge this the less problems we will ALL have. At the end of the day I have paid for a signed service to be delivered (not in a hidden place where you can’t find it) to my address. Why are we not trying to sort these delivery companies out! There are over 9K comments for FedEx with 1.2 score. When I purchased the goods they did not say who was responsible for the deliveries. That sounds like an opportunity for some delivery companies shine.

If someone had taken it, then it would have been the senders issue to resolve, not yours. Unless you paid FedEx for the delivery (which it sounds like you didn't), then you have no contract with them and therefore no grounds for a complaint with them.

But it wasn't taken, so the question is, what outcome are you looking for, and from whom?

If you paid extra for a specific delivery date, or extra for a signed for delivery, and that did not happen, then you may have claim against the seller for that additional amount you paid. But, if you just paid for delivery, you got the service you paid for.

You said above "a crime is a crime". Do you think a crime has been committed here?
