Firstly a comment about the house.

Are you certain about house ownership and the current ownership as stated in the land register entry? It is not uncommon for house ownership to still hold the name of a predeceased spouse (without a survivorship clause).

    Suggestions

    Cover letter.

    Use (Removed by Forum Team).

No need to reference paperwork regarding the house or mortgage, the court does not wish to see these and will accept your entry on the C1

If sending in the C1 you need to produce the id requirements stated here https://www.scotcourts.gov.uk/taking-action/dealing-with-a-deceaseds-estate-in-scotland/large-estates/

    Page 1

    Box 2

Use ‘(Removed by Forum Team) xxxx’

    Box 5.

    Enter ‘Retired wages clerkess’

    Box 10

Enter ‘(Removed by Forum Team) XXX YYYY or TTTT. Where YYYY is maiden surname and TTTT is married surname.

    Top box.

Enter only ‘(Removed by Forum Team) XXX YYYY or TTTT and current address.

    Page 2 Para 1

    Ist box

(Removed by Forum Team) xxx xxxx otherwise known as (Removed by Forum Team) xxx xxxx

    2nd box

should say - ‘Sheriffdom of South Strathclyde, Dumfries and Galloway in Scotland’

    Suggestion for para 2

    That I am

The daughter and executor nominate of the deceased conform to will dated 21 January 1994 produced herewith docquetted and signed as relative hereto. In said will I am named (Removed by Forum Team) XXXX XXXX and I am designed as residing at xxxxxxxxxxxxx a former address. Ian xxxxxx the husband of the deceased who was appointed executor primo loco in said will predeceased the deceased. In said will the deceased is named .r.ft xxx xxxx.

    Para 3

In the first box enter only your name in the format (Removed by Forum Team) XXXX YYY or TTTT

    Inventory.

Item 1. Use ‘under title number’

Item 7 omit the word ‘refunded’

After the summary for confirmation insert an entry ‘Estate elsewhere - nil’

    Page 4

    UTR enter ‘not known’

Box 15, if entering manually delete the zero

Thank you so much. I’ll redo form and submit.
Should I change ‘Moveable estate in England and Wales’ to ‘Real and Personal estate in England and Wales’?
Unsure what you mean by Item 1. Use ‘under title number’
The Land register entry is in both names, I.e. (Removed by Forum Team) & (Removed by Forum Team). Do I have to do anything about this?

Thanks again for all your help

Instead of saying ‘under the number’ say ‘under title number’

If the land register has both names, is there survivorship in the proprietorship section?  If so no problem, ownership automatically passed to (Removed by Forum Team) on (Removed by Forum Team)’s death.

If there is no survivorship in the proprietorship section, then what happened on (Removed by Forum Team)’s death? Was there a will? Who inherited (Removed by Forum Team)’s share? Was Confirmation issued?
