PCN - Store willing to Cancel - Parking Eye refuse?

Hi All,

I got a parking charge that I appealed to Parking Eye and POPLA and was refused on both.

The PCN was from 11/03/26 and only got the rejection on Wednesday 07/0726.

I then decided yesterday to email the store and surprisingly the manager agreed to contact Parking Eye to cancel my PCN. I was very pleased and sent him a thank you email.

This morning I wake up to another email from the manager saying Parking Eye refuse to cancel it as I have appealed.

Anyone else heard of this?

Obviously I don't want to pay as I have in writing that the manager is happy to cancel.

Thank you for your recent message, im a little confused over this, as you have told your staff/agents to cancel and they are now continuing to pursue, this would appear to be a case of the tail wagging the dog.

It would appear that you need to tell parking eye to cancel this charge as previously stated, and you agreed to do, for the avoidance of doubt, Parking eye are perfectly capable of cancelling this., and any other charge that they have fabricated, The private parking sector is ( currently ) un regulated and is able to make its own rules up to suit itself.

If Parking eye have told you they are unable to cancel their own made up charge, then they are at best deceiving you

Once PE have successfully gone through the POPLA process (and having paid their £30 POPLA fee), they have been notoriously stubborn to shift, despite landowner intervention.

If you get no further joy (as per @Half_way’s advice above), you will just need to ride on through and see what, if anything, PE decide to do. Having a written agreement from the manager to seek a cancellation, will be powerful evidence should this ever get to litigation.

I haven't heard back from PE (even though they told Store they had), both responses were from the Store Manager. Pic below are the emails received (redacted)

The Unable to cancel line is an outright lie from parking eye.

they are a private un regulated company, there is no statutory authority that sets a process in motion, all their motions are entirely made up

Even Popla is not independent in the true meaning of the word, the "rules" that Popla "adjudicate ( that word is used in its loosest possible meaning) are set by the parking companies via their private members trade association(s) Popla and not by any independent authority or body, Popla is also funded by the industry

They can cancel, they are lying, and stringing you ( and the store manager) along for a mug

You might want to do a check on their website to determine the status of your parking charge. Maybe they could have had a rethink and cancelled. But don’t hold your breath!

Happens every time when people rush off to POPLA without coming here first.

You did it the wrong way round which is why landowner complaint is 'Plan A' both in the MSE Guide and in our NEWBIES FAQS thread. You must NEVER try POPLA first, as you have discovered you have ruined your dead easy Plan A cancellation.

You'll now have to defend it in court if the retailer won't insist and push ParkingEye.
