Starting the Defence

Hello all

As requested I have started a new thread.

This where I am thus far. I have followed the instructions to defend the whole amount. Now I am starting the defence. When you start the defence, it states defence - counterclaim. The page states:

Before you can make a counterclaim against the claimant you must:

be defending all or part of the claim against you

and

have indicated in your defence that you intend to make a counterclaim

You must pay a fee to make a counterclaim unless you qualify for a fee remission. The amount you have to pay depends on the amount you are claiming - see the table below for a list of fees.

I haven't stated that I am making a counterclaim so do I just ignore this and continue or should I be making a counterclaim. The fee to counterclaim is £35 for claims not exceeding £300.

Thanks in advance.

You probably do not have any legal grounds to counter claim, so ignore that bit, or whatever you need to do to get past it, such as NO , you use the start defence box

Make sure that you are using the template defence and have adapted the correct paragraphs 2 & 3 only

Then copy and paste it into the defence box, save it and submit it

    Hi

I've now received the Directions Questionnaire which has been completed by the claimant. What do I need to do now?

    TIA

File it away in a drawer, then study and follow the 8 steps in the 1st post in the defence template thread in announcements near the top of the forum, download it, fill it in, save it, email it
