Another question which is probably an obvious answer, our son has autism and we've been advised to make a will in trust so that when we pass he won't lose his benefits by inheritting.
Can we "give" our house to him now? Would it be classed as capital and he'd lose his ESA?, tia

You can give away anything you like but giving your home away or putting it in trust while still using it as your home would be extreamly foolish. What you have been advised to is far more sensible.

Yes, leaving assets in a Disabled Persons Trust (DPT) is wise as it protects his future entitlement to means-tested benefits. Any competent solicitor will be able assist including it in a will. My stepfather had one set up for one of my sisters for the same reason.
"Giving" (air quotes) your house to him now would be incredibly reckless and unwise, considering you can already achieve the objective with what you have already been informed, but conversely invites a plethora of new risks.
