Napier & BW Legal Keying Error Success

Hi everyone.

I parked my car in a Napier-run car park and paid the right tariff so I was suprised when a week later I got a fine through from Napier. I found my receipt for the parking app I used and realised I had my wife's car selected instead of my own. I assumed if I just explained this to them all would be fine. At the time I hadn't looked into what I should do if this happened and so I just went through their portal and gave them all the information they wanted (I didn't realise I was dealing with snakes) obviously they wouldn't except this and decided they would tell me I had to give them more money.

I then came to this forum and started reading the threads. I decided not to appeal through the BPA because I knew it was going to be pointless and I didn't want to legitimise their crooked process by following it. I didn't respond to any of the threatening letters from Napier and soon after the letters from BW Legal, until I got the letter before claim, which I responded to using an amended version of the template provided on this forum.

After that I followed the guidance here which was especially useful in relation to all the court stuff which can be really confusing to ley people. I went through the mediation call where they told me how much trouble I was in. I refused to pay them anything. Mediation was a waste of time.

When it came to paying the court fee they decided to discontinue. Obviously I am pleased, but I have already put a lot of work into my court defence and I would have been ready to give it a go. Even if it would have been just a roll of the dice on the judgement as it often seems to be I believe you have to try to resist something when it's unjust even if a judge might decide it's "perfectly" legal.

I want to say a huge thankyou to the contributors on this forum, especially Coupon-mad, Gr1pr and Le_Kirk (there are others whose names pop up a lot but I can't recall them now, sorry, but thank you all). You guys must be on here all the time, I salute you. It isn't just the technical advice that is helpful, it is all the times I see one of you tell someone not to pay and that they can triumph against this BS. This reassured me that I was on the right path.

Well Done, and thank you, but never call these private parking company invoices fines ( magistrates issue fines, but not in regards to private parking. )

They will often tell people that they are in the wrong and should pay up, yet dont want their fairy stories tested in court, so discontinue instead

People just need to stick to the advice given on here, even though most of us are also lay people , so you did the right thing in coming here and doing so

You can always write to the judge and enclose a costs assessment (£24 per hour) and explain the unreasonable conduct of their bulk litigators who never intended to take this all the way to a hearing and likely have a contract with the parking company that agrees that all single ticket claims are to be discontinued at the eleventh hour, wasting both the court's time and any defendant who complies with the judge's Order to submit a witness statement.
