Under PoFA 2012 it is the KEEPER not the REGISTERED KEEPER who may be liable

Para 2(1) states

• “keeper” means the person by whom the vehicle is kept at the time the vehicle was parked, which in the case of a registered vehicle is to be presumed, unless the contrary is proved, to be the registered keeper;

As you have proof that you were not the keeper - you can discharge liability anytime before the Creditor has commenced court proceedings.

If they refuse to accept that and issue a claim against you , you can counterclaim for misuse of your data etc . But you have to make that very clear to them to prove that they ought to have known that you were not the keeper .

DCBLEGAL in my experience are usually ok with accepting such evidence and discontinue or allow the claim be struck out at early stages if they did not have this information prior to court proceedings.
